University Officer Sues Las Vegas, New Mexico, Two City Officers

LAS VEGAS, N.M. (AP) -- A Highlands University police officer is suing the city of Las Vegas and two city officers, contending they wrongly arrested her.

Michelle Espinoza, in a lawsuit filed last week, alleges officers Lawrence O'Conner and Pam Sandoval falsely arrested her Jan. 26 for driving on a suspended license when it had been reinstated. She said she presented a valid identification, but the officers refused to accept it.

Her lawsuit, which seeks an unstated amount of damages for emotional distress and pain and suffering, alleges false arrest and imprisonment, negligent supervision and negligent investigation.

Acting city manager Esther Garduno-Montoya said Tuesday the city has not received the lawsuit and cannot comment until officials have seen it.

According to the lawsuit:

Espinoza was driving when she overheard Sandoval identify her car on the police radio, then Sandoval pulled her over and told her she was under arrest for driving on a revoked license.

Espinoza said she told Sandoval her license had been reinstated and presented a valid ID, but that Sandoval cuffed her when she extended her arm. O'Conner joined the effort to handcuff her other arm.

She insisted she had a valid license, but the officers would not listen and pushed her into Sandoval's patrol car.

Only then did they call dispatchers for a driver's license check. They let Espinoza got when they found out her license was valid.

Highlands Police Chief Paul Sena showed up then and told the city officers he wouldn't let one of his officers drive on a revoked license.

Espinoza then called Sandoval a name, prompting Sandoval to threaten to arrest her. Sena intervened, saying officers couldn't arrest someone for expressing an opinion.

When Espinoza drove away, Sandoval followed with her emergency lights flashing

Yeah that makes sence, arrest someone for showing you a valid license. Dont check it first to make sure, jeez if that is the way it played out thoses cops did not use very good judgement. Who here is gonna slap on cuffs unless you do a full CJIS check first. Not to mention she is sister officer you would think there would be some leway, but who knows if thats the whole story.

For whatever reason, some cops enjoy locking up other cops. Some kind of power trip, not the type of cop I want backing me up. Yet then again their may be more to the story and I could be completely off base.

When did they move Las Vegas to New Mexico?? That must've cost a ton! Moving all them pretty lights and casinos...

Maybe she was giving them a hard time. Some cops do have the mightier than thou, I'm a cop type attitude. Working on the Cape and Islands unfortunatley I have dealt with some cops that were real assholes and made my job very difficult. I have a buddy that is a Harwich cop and he told some crazy stories of Boston cops taking things way too far.

I personally have dealt with a lot of cops from NY that were unbelievable, and then there are the big city cops that come up talk to ya and just shit on ya cause you are a town cop. I bet there is MUCH more to that story.

Bottom line you dont take shit form ANYONE even though I take more than I should from other cops. Thats the only thing I hate about the summer season down here, I would rather make new frineds in other depts then the latter.
