In Texas Falls County Constable H.F. Westerman Jr. has resigned after he was ordered to do so by state officials who suspended his law enforcement license for 10 years.
The Texas Commission on Law Enforcement Officer Standards and Education handed down its decision late last month, and Westerman was given 20 days to respond, said Falls County District Attorney Jody Gilliam-Morris.
Westerman, who is in his mid-70s, turned in his letter of resignation to the county Monday, Gilliam-Morris said. His resignation is effective July 31, his letter states.
Westerman was convicted in June 2003 of indecent exposure. According to witness testimony at his trial, Westerman was seen masturbating in his pickup outside a Waco grocery store. However, he testified the witness might have seen him shaking a bottle of Pepto-Bismol he was taking for a stomach ailment. He was placed on probation for 18 months and ordered to pay a $200 fine a year later. He lost his 2005 appeal.
Westerman was on the November ballot for a third, four-year term as constable in Precinct 3, which covers southern Falls County.
