A Mattapan man arraigned yesterday on a murder charge, after prosecutors said he gunned down a rival he ran into at a Halloween party in Roxbury, was free on bail on a previous gun charge at the time of the slaying.
David Yarde, 22, in Roxbury District Court yesterday to face charges in the Oct. 28 shooting death of DeAndre Russ, was busted Nov. 4, 2010, after Transit Police stopped him for fare evasion at Ashmont Station and discovered he was armed, said Suffolk Assistant District Attorney Julie Higgins.
A Dorchester judge released him on $5,000 bail at his 2010 arraignment, dismissing a prosecutor's request for $15,000 bail.

Unfortunately, bail is intended to keep dangerous people off the street. It's intended purpose is to insure that the defendant shows up for trial.

This is a great attention grabbing headline but its not as appalling to me as it would have been if he had been released after a dangerousness hearing.
