The fact of the matter is that the Sheriff did OFFER to take over police services for free. Just because he offered them doesn't mean CRAP because the town will pay forever in legal bills and backpay to the officers if they accept the offer. You keep saying that sheriffs don't want to be police officers. That is the biggest crap I ever heard, I have never ever met a happy correction officer that says "I love my job, can't wait to go in and do this for another 30 years". The fact is that the Sheriff is trying to push their foot in law enfocement because their flunkies could not make it through a legitimate hiring process to get on a police department. The bright ones move on and go on MSP or local, federal. Just becasue you are the EXCEPTION and love being a correction officer and have no aspirations to go to a PD does not mean that the rest of the guys do too. All the PDs have to get together and stop this guard nonsense taking over PDs. MCJTC is already putting a stop on training deputies to their FT academies and hopefully that will nip in the butt. I know you will respond to this and this will go on forever. Let's not forget the real issue here, JAIL GUARDS ARE TRYING TO TAKE OVER POLICE DEPARTMENTS. It's that simple!

And the deputy could not have done anything to the Leominster officer because Deputies have no right of arrest on a motor vehicle stop unless it amounts to a breach of the peace. I would have gine him my "uni-digital" response and drove off too. Then I would have got on my cell phone and call C-4 barracks and tell them a I was just pulled over by a mad man with a star badge claiming to be John Wayne. The vehicle was described a prisoner transport van with blue lights and election bumper stickers. :lol:

Seriously though, all this can be eliminated if the Department of Correction took over all count sheriff departments. The correction oficers would have a Group 4 state pension, better pay and better benefits. Their job security would also be greater, not stressing over who takes over and where you will be re-assigned. The take over would also eliminate the push to perform municipal law enforcement functions. If the sole responsibility and primary functions of the Sheriff Department is Corrections and Process Servers then the DOC would take over that responsibility. They can still have K-9 units and SWAT teams for their DOC facilities and not to interfere with other LE agencies.

Otto, I am curious. About a month and a half ago three officers from my department had judge traffic appeals in a Court House in Worcester County. Also present were a few deputies from the Worcester Cty Sheriff's Department that issued civil motor vehicle infractions to a few violators. Where are these citations being written and why do deputies write CMVIs when they should not even have the books. Are they older D series books? Registrar already confirmed that he does not issue any books to the Sheriff Departments because they cannot have them. So if that is the case, who is pulling over cars from your agency and why? You can see that there are plenty of concerns and we all just want some answers.

Also one of the discussions that came up recently with some police officials is that when a deputy pulls a vehicle over and the driver fails to stop. WHat authority does the deputy sheriff have? Clearly Chapter 90 Section 25 states the following:
Chapter 90: Section 25 Refusal to submit to police officer

Section 25. Any person who, while operating or in charge of a motor vehicle, shall refuse, when requested by a police officer, to give his name and address or the name and address of the owner of such motor vehicle, or who shall give a false name or address, or who shall refuse or neglect to stop when signalled to stop by any police officer who is in uniform or who displays his badge conspicuously on the outside of his outer coat or garment, or who refuses, on demand of such officer, to produce his license to operate such vehicle or his certificate of registration, or to permit such officer to take the license or certificate in hand for the purpose of examination, or who refuses, on demand of such officer, to sign his name in the presence of such officer, and any person who on the demand of an officer of the police or other officer mentioned in section twenty-nine or authorized by the registrar, without a reasonable excuse fails to deliver his license to operate motor vehicles or the certificate of registration of any motor vehicle operated or owned by him or the number plates furnished by the registrar for said motor vehicle, or who refuses or neglects to produce his license when requested by a court or trial justice, shall be punished by a fine of one hundred dollars.
The law specifically states "POLICE OFFICER". If the law assumed that deputy sheriff have powers to enforce Chapter 90 , then why are they not in the law. Comm. Vs Baez was a bullshit decision that came down with the following: A sheriff may only arrest an operator for an arrestable MV offense if it amounts to the breach of the peace. Therefore a deputy makes the arrest for a breach of peace, disorderly conduct or disturbing the peace and not for an arrestable MV offense.

Hi, interesting, I just read the LEAPS BOLO on the Sheriff Impersonator? that stopped the LPD officer on Rte 12 in Leominster. It could be a big issue now that elections are coming for a new sheriff.

Hey K9 sheriff, you should do your homework before blabbing about things you think you understand. Its guys like you that interpret the law and make bad case law. A police officer is not a sheriff, and a sheriff is not a police officer. The Sheriff cannot issue books, look at the law and look at the case decision in Baez. I am FT officer and I went to a academy where they told us that the sheriff IS NOT A COP!!!!!!!

P.S. Want to write Vs become a cop. I dont see the State DOC pulling cars over and issuing citations.
