Spanish Judge Orders 3 U.S. Soldiers Arrested For Iraq Action

UPDATED: 1:36 pm EDT October 19, 2005

MADRID, Spain -- A Spanish judge has issued an arrest warrant for three U.S. soldiers in connection with the death of a Spanish journalist in Iraq.

The 3rd Infantry soldiers were part of a tank crew that fired a shell at the Hotel Palestine in April 2003. Several journalists who were covering the war were staying at the hotel in Baghdad.

An employee of the Spanish television network Telecinco was killed, as was a Ukrainian cameraman for the Reuters news agency.

The Spanish judge said he issued the arrest order because the United States has not been cooperative.

U.S. officials insist the soldiers believed they were being shot at when they opened fire. Then-Secretary of State Colin Powell said a review of the incident determined that the use of force was justified.

Colin Powell should have said that the soldiers mistakenly thought that there were French reporters in the hotel when they opened up.

In limited circumstances, like when it involves citizens and nationals of your country.

If a US Citizen/National murders another US Citizen/National outside the USA, the US Gov't can still charge them (Title 18 Sec. 1119). If you conspire to kill a foreigner you can get charged under (Title 18 Sec. 956) regardless of your location, so there are US laws that govern offenses outside the United States. I can only imagine that Spain has similar laws protecting its journalists.

The Spaniards can charge them all the want. The fact is, the soldiers are here and the Spanish warrant doesn't mean jack.
