    Judge: Detective can't be retried in suspect assault

    A Rhode Island Superior Court judge ruled Friday that a Providence police officer cannot be retried for assault in the arrest of a suspect.
    Detective Robert DeCarlo was found guilty of assault with a dangerous weapon in the 2009 beating of Luis Mendonca, which was recorded by a surveillance camera.
    Mendonca had fled police after he was stopped on suspicion of theft and trespassing at the Rhode Island School of Design.
    A judge vacated DeCarlo's conviction last year, saying a state prosecutor went too far in her closing argument.
    Associate Justice Francis Darigan said Friday that the prosecution's misconduct in the case was so egregious that allowing the state to retry DeCarlo would violate his constitutional protection against double jeopardy.
