Hearing Held In Poison Cake Case :shock:

MARIETTA, Ga. -- One of the two girls accused of bringing a cake to school that sickened about a dozen students will not return home to her parents after a judge denied a motion Friday to give them custody as she awaits trial.

Both teens were charged with 12 counts of aggravated assault with intent to commit murder. One girl was also charged with terroristic acts and interference with government property.

The 13-year-old girl has been charged with 12 counts of aggravated assault with intent to commit murder, one count of terroristic acts and one count of interference with government property for allegedly baking and distributing a cornbread cake made with bleach, glue, tobasco sauce and other substances.

Cobb County Juvenile Court Judge J. Stephen Schuster ordered the girl returned to the custody of the youth detention center where she has been since her arrest Wednesday.

However, he allowed the Department of Juvenile Justice to place her in a non-secure shelter where she will live under state supervision.

Scuster, meanwhile, released the other 13-year-old girl accused in the case to the custody of her parents.

District Attorney Pat Head said the decision was made after hearing testimony describing her as an honor roll student and competitive cheerleader with no history of discipline problems, that girl is believed to only have taken part in baking the cake, but not distributing it to classmates.

The father of the other East Cobb Middle School student said Thursday his daughter has a mild form of autism that sometimes causes her to make inappropriate statements and makes it difficult to relate to others.

Two 13-year-old girls accused of serving poisoned cake to their classmates made their first appearance in Cobb County Juvenile Court on Wednesday.

The father said his daughter was diagnosed this summer with Asperger's syndrome, and that doctors told him the girl should not be in a conventional school setting.

Asperger's is an autism-related condition characterized by social and communication deficiencies.

He said his daughter did not mean to harm anyone with the cake.

"It was a horrible prank that went too far and a lot of people have suffered," the father told The Associated Press. The man asked that he not be identified by name to protect his daughter.

Some of the students started vomiting after eating the cake in the school cafeteria Tuesday. Eleven students, mostly seventh-graders, were treated at a hospital and released.

The father said the two girls began playing around in the kitchen Tuesday after growing bored.

"It was not any kind of malicious intent," he said. "They thought it would be funny. They know it's not funny now."

Police said they are baffled as to why the girls would bring a poisoned cake to school.

"At this point we don't have any motive," said Cpl. Dana Pierce, a police spokesman. "That's part of the mystery."

School system spokesman Jay Dillon said the girls apparently did not target anyone in particular when they offered it to classmates.

"They were offering the cake to anyone who would take it," he told the newspaper.

Dillon said regardless of the outcome in court, the girls face long suspensions and possibly could be expelled.

They must have know something bad was going to happen when they were mixing it up, ya know, maybe the smell of the bleach would have made the girls think twice?

Ok, well the article stated that there was a mental problem as a factor... not that it's an excuse, but if she's normal enough to comprehend what she did is f'd up, then she can still learn a lesson well learned. I think even mental cases can understand that sinking in your feeling stomach when you know you're in the shit.

God knows I do!!!! :wacko:

Putting hot sauce in the cake is a prank, the bleach is criminal! There would not be a question if a child died. Kids today need some serious help first the post about the 6 year old with the glass cutting himself now this one, makes me glad I do not have kids.

It's not the kids, it's the parents. People suck.

It's the same thing with all the complaints about pit bulls, etc., running around and tearing people's faces off... there's no such thing as bad dogs, there's only bad owners. They need to be trained, disciplined... much like children.

In this case, there is a problem of mental difficiencies. Ok, fine. However, the child's problem doesn't seem so severe that she couldn't understand how serious this is and to never do something like that again. Hell, I did some seriously stupid shit when I was a kid (of course, not to the point where I could have killed or seriously caused some bodily harm) and I supposedly have an I.Q. of 155. I think with retarded children more leniency is required, but punishment is not to be ignored.

You're right..Everything about your post is right. It's the parents. My husband and I see people all the time that are just bad parents. I hate to say it, but a lot of parents now have children when they're not ready (or are two young) and just don't give a crap about what their children are doing. It's horrible and I hate it, but it's truth.

Parent's/owners etc need to be held just as accountable, if not more then this little girl. The fact that the father knew and did nothing. C'mon now...that's crap.

Ugh. Enough preaching today, you all know it's true, which is so sad.

I think the point we are missing is this: out of the two children, ONE WAS NOT MENTALLY DEFECTIVE! What was she thinking? What bullshit! A couple of murdering little monsters, and their murderous parents...death to all! :twisted: Apparently the mental defective was detained...while her friend, who told no one about this and actually abetted this, remains free: Who needs to be locked-up?

I would not classify this as a prank. at 12 and 13 the children knew putting bleach into a food substance could cause serious bodily injury, or death. As far as the court goes I hope they throw the book at the two little B---hes. I dont agree about holding one and releasing the other to mommy and daddy. Its my opinion that the two darlings baked the cake together that means they both are in a world of Shit. Anyway too bad the Little shitbirds arent old enough to be tried as adults. :twisted:

It all comes down to good parenting, if your a shit parent your gonna have shit kids!
