Ohio Ex-Chief Convicted Of Paddling Young Traffic Violators

WARREN, Ohio (AP) -- A jury convicted a former township police chief on Thursday on 18 misdemeanor charges for paddling teenage boys stopped for minor traffic violations.

A Trumbull County Common Pleas Court jury convicted James Martin, 52, a former police captain in Howland Township and former chief in Fowler Township, on 12 counts of using a sham legal process and six counts of dereliction of duty.

He was acquitted of the only felony, a theft in office count, and 10 counts of assault and six additional counts of dereliction of duty. The jury was unable to reach a verdict on one assault count.

Martin hugged family members after the verdict was returned. Attorney Dominic Vitantonio said he expected to appeal the convictions and would ask the judge to throw out some of the convictions.

Assistant Prosecutor David Toepfer said he would oppose overturning any convictions.

The paddling was done with the approval of parents as part of an unsanctioned diversion program in Fowler Township, located near Youngstown in northeast Ohio.

Some witnesses said Martin gave them a choice to volunteer for the diversion program and that he acted in their best interest by banning use of tobacco products, insisting that they get good grades and obey their parents.

The felony theft charge alleged that Martin kept records from a previous diversion program that he ran in Howland Township.

Sentencing was set for March 1. The dereliction of duty counts carry possible three month jail terms and the sham legal process counts carry possible six month terms

So where does this fit in an officers discretion options? verbal warning, paddling, written warning, and citation? Does the paddling show on the driver history?

The parents condoned the "diversion program" :shock: They sure have some real progressive policing methods in Ohio...

ohio is a very wierd and strange state. I have met a few people from ohio and they were a few sppices short of a rack.
