offense : truck, pickup, allowing children under age 12 in bed of ( farm trucks exempt) ---from my 2001 mv index $ 35 fine

statute/ CMR : C.90 $13 A "no person shall operate a motor vehicle, commonly known as a pick up truck, nor shall the owner permit it to be operated fro a distance more than 5 miles, in excess of 5 mph, with persons under the age of 12 in the body of such truck, unless such truck is part of an official parade, or has affixed OWNER REPAIR or FARM license plate..... it goes on to say that garbage men, firefighters and utility workers can hang from the end of vehicles and kids on skates or bikes cannot hang onto."---from my 2002 mass criminal law and motor vehicle handbook

or how about since we are all animals just try the C. 90 $ 22 H Transporting unsecured animal in load area of vehicle ( pick up beds) $ 50 fine

This may work im still learning MA law....down here in VA it's under $ 46.2-1156.1 Transportation of persons less than 16 yrs of age..parades are an exception, or crossing the street in the farm

Cardio, what's wrong with the seatbelt whack? It can't be your reason for the stop, but it does not affect their insurance like a moving violation, and maybe they will realize there are better/safer ways to travel... or you could just yell at them.

Stop 'em! While there may be no specific law about it, your job is to protect the safety of people on the road. What if you passed by and put on the blinders and they crashed. The rear passengers would get tossed like ragdolls and killed. Then you'd have a real liability problem. I can see it now: "Officer, you saw my client, the deceased, doing something inherently dangerous and did nothing to prevent it before the crash which killed him." What's to say you can't stop them and advise them of the danger of riding in the back? If something more comes of it (arrest or summons) then be sure to articulate the safety issue in your report. rhl

Is the MV stop justified if there is no law covering people riding in the back of the truck? I have always wanted to make the stop. I do think it is very dangerous and people could easily get killed in an accident. However, if I do get an arrest or summons would the stop be justified in court? Also important if the stop flies with Sgt. or Lt. I agree that the stop should be justified since the safety of the public is at risk. There should be specific law covering this issue.

If you read towards the end of 90-13 it states, "No operator of a motor vehicle shall knowingly permit any person to hang onto or ride on the outside or rear-end of the vehicle or street car." That should cover it. [/i][/b]

Hold it! Not quite.................

Thats easily interpreted as tailgate/bumpers/running boards, things on outside of vehicle. Wise guys will easily argue that enclosed pick-up bed is a cargo area and not "outside" the vehicle.

Just stick to the twelve-year-old rule and save their lives, or become a legislator and fix the law as you see fit

Just an aside here. Does anybody remember the vehicle that was like a pickup, but had seats in the back. I want to say it was a Subaru of some kind. Maybe a Subaru Justy. Does that sound right? rhl

I think you would be hard pressed to find one of those now or days that wasn't a complete bucket of rust.
