MV Inventories

Case just came out yesterday 12/30/03. Comm. v. Brinson. "the government may not impound and conduct an inventory search of a car based on the arrest of the owner, where the car was lawfully parked in a privately owned parking lot and there was no evidence that the car constituted a safety hazard or was at risk of theft or vandalism."

Could be that this officer barely speaks English and was hired off the Haitian Speaking list. Brockton PD has no MV Inventory policy. There was an incident a few years agoi where a vehicle was towed because it was found in the trees by the junk yard(very expensive car but was not stolen). Because there was no inventory policy, the officer missed the driver in the trunk with two bullets to the head. The tow truck company found him at the impound lot. :DP:
