MV Inventories

Case just came out yesterday 12/30/03. Comm. v. Brinson. "the government may not impound and conduct an inventory search of a car based on the arrest of the owner, where the car was lawfully parked in a privately owned parking lot and there was no evidence that the car constituted a safety hazard or was at risk of theft or vandalism."

Perhaps the vehicle involved in Comm. v. Brinson was parked in a secure parking facility, such as a multi-level mall lot with security?

Even these type of facilities have break-ins... in some areas even more so than unattended lots.

I'm sure plenty of other PO's can attest to this...
I agree with you 100%. I was just trying to figure out the logical reason for the ruling in this case.
