Mistrial declared in Mass. double murder case



WOBURN, Mass. -- A judge has declared a mistrial in the trial of a New Hampshire man charged with killing his ex-lover's husband and another man after the jury claimed it was hopelessly deadlocked.
The Middlesex District Court panel had deliberated the case against 46-year-old Sean Fitzpatrick since last Thursday. Judge Kathe Tuttman declared the mistrial late Tuesday after the jurors insisted they could not reach a unanimous decision.
Authorities say Fitzpatrick, of Freedom, N.H., shot 39-year-old Michael Zammitti Jr. in March 2006 after Zammitti's wife, Michelle, ended their affair. They say Chester Roberts, who worked with Zammitti, was shot when he walked in at the wrong time.
Fitzpatrick testified he had nothing to do with the killings.
Prosecutors say they will prepare for a second trial.

Jury considers fate of NH man in Mass. slayings

WOBURN, Mass. -- A jury is set to begin deliberations in the case of a New Hampshire man charged with killing his ex-lover's husband and another man at a Wakefield business.
Closing arguments were made Monday in Middlesex Superior Court in the retrial of Sean Fitzpatrick, who is accused of fatally shooting Michael Zammitti Jr. in March 2006 after Zammitti's wife ended their relationship. Zammitti was the owner of Allstate Concrete Pumping.
Prosecutors said Chester Roberts, an employee of the company, was shot when he happened to enter the room at the wrong time.
A mistrial was declared in August when another jury said it was hopelessly deadlocked on the charges against Fitzpatrick, who testified that he was asleep at his home in Freedom, N.H., at the time of the shootings.
The jury in the retrial was expected to begin deliberations Tuesday after receiving instructions from the judge.

Man convicted in love triangle slayings



WOBURN, Mass. -- A jury has convicted a N.H. man in the 2006 slayings of his ex-lover's husband and another man at a Wakefield business.
A Middlesex Superior Court jury found Sean Fitzpatrick guilty of murder Thursday after deliberating for more than a week.
Fitzpatrick was accused of fatally shooting 39-year-old Michael Zammitti Jr. after Zammitti's wife ended their relationship. Zammitti was the owner of Allstate Concrete Pumping.
Prosecutors said 54-year-old Chester Roberts, an employee of the company, was shot when he arrived at work right after Fitzpatrick shot Zammitti.
A mistrial was declared during Fitzpatrick's first trial in August after another jury said it was hopelessly deadlocked.
Fitzpatrick claimed he was asleep at his home in Freedom, N.H., at the time of the killings.
