This is a legitimate question. It is not meant to demean the MBTA police nor do I want any responses that do. I am fully aware that the MBTA police have ch90 in just about every city and town in the state. My question is: How do they derive this power? Is it from legislation? If so what chapter and section?

Also does anyone know the "alledged" chapter and section that took away ch90 from many campus departments?

Taken from Scheft, Criminal Procedure Station Guide 2005, page 7-6.
Hope this helps

"MBTA Police officers are empwered under both G.L. c. 41 S 98 and G.L c. 159 S 93. THus MBTA police offiicers have the powers conferred or imposed upon police officers in cities and towns under S 98 as well as street railway police powers granted under S 93 within the territorial limits of the authority. The legislature has gone even further in defining the authority of MBTA police officers by empowering them under Chapter 90C to issue citations for motor vehicle violations. Comm. v. Mottola, 10 Mass. App. Ct. 775 (1980) (MBTA police officers had the authority to question and arrest the defendant at high school because the offense originated on MBTA property and related to the protection of an MBTA passenger)"
