LAWRENCE, Mass. -- The driver of a sport utility vehicle that struck and killed an 11-year-old boy crossing a busy street in Lawrence a year ago will spend 90 days in jail.
James Gianni was found guilty on Wednesday in Lawrence District Court of driving to endanger, but was acquitted of the more serious charge of vehicular homicide. He was sentenced to 18 months behind bars, with all but 90 days was suspended. He also lost his license for three years.
Authorities say the 50-year-old Gianni was behind the wheel of an SUV that struck and killed Dario Rodriguez trying to cross Route 114 on Oct. 1, 2007. Gianni was aggravated by a slower driver in front of him and went over the speed limit as he passed.
