Man admits faking injuries

A 51-year-old Rockport man who claimed he was hit in the head by a wooden block falling from the roof of Jazzy Joe's Bar on Main Street in 2006, admitted yesterday in Gloucester District Court that the block missed him and he faked his injuries.
Joseph Foley, who police say has no address, pleaded guilty to insurance fraud and attempting to commit larceny and was sentenced to one year probation by Judge James LaMothe. He was fined $90 and ordered to stay away from Jalapenos restaurant, whose owners owned Jazzy Joe's.
On Feb. 14, 2007, Foley told his insurance company, Travelers, that he suffered head and neck injuries when a block of wood that was part of a construction project at Jazzy Joe's fell from the roof and struck him in November 2006, according to Massachusetts Attorney General Martha Coakley's office, who prosecuted the case.
The insurance company acquired a copy of a surveillance tape from a nearby building which showed the block falling from the roof of the building, but entirely missing Foley.
Jazzy Joe's has since closed due a combination of financial and legal troubles.
