Police find drunk man passed out in car with his kids in the back

Raw video,July 16/08: David Novick, his friend and Novick's three kids managed to get to the gas station safe and sound, driving a couple blocks from his home down SR-50. He went there to buy cigarettes and passed out with his children, all under five years old, in the car.

Novick never saw the police coming. The 37-year-old Titusville man was out cold when they showed up. His three children were unbuckled in the back seat of the parked car. Police questioned whether there was something more than alcohol involved.

The single father was so out of it, not police, not a slap in the face and not even police removing his children could get him to wake up.

"Dave, they are taking the kids," Novick's friend told the passed-out dad.

When he finally did get out of the car, police said Novick failed a sobriety test and a breathalyzer indicated he had a blood alcohol level of .152, nearly twice the legal limit. He was arrested and charged with DUI, driving with a license suspended and, because there were three children in the car, three counts of child neglect.

The three small children were placed in the care of Novick's girlfriend.

"They miss him a whole bunch. They love their dad and he loves them. He's a really, really good dad. He is," said Novick's friend Shamra Sika.

Novick is being held in the Brevard County jail on $30,000 bond.
