A lawyer from one of the ritziest cities in Kansas was charged with soliciting a minor over the internet. The court found him guilty but then the judge ruled that his attorney's position was correct and reversed the ruling. The argument was that the Adam Henry solicited a police officer acting as a minor...not a minor herself. There is no law forbidding solicitation of a police officer acting as a minor! What a crock of chit! Unfriggin believable! This judge needs to be removed from duty!!!!!

Enticement case now in state court

A Mission Hills lawyer, whose federal conviction of child enticement was thrown out earlier this week, was charged Friday in state court by Platte County authorities.

Jan P. Helder Jr., 42, is accused of with using the Internet in an attempt to entice someone who he thought was a minor. Helder actually was communicating with an undercover Platte County sheriff's deputy. Helder has not been arrested and is expected to surrender to authorities, said Prosecutor Eric Zahnd.

J.R. Hobbs, the attorney for Helder, said he would make arrangements to have his client surrender to authorities.

"A not guilty plea will be entered and addressed in due course," said Hobbs who declined to comment further about the state charges.

Zahnd said his decision to file state charges was the result of U.S. District Judge Dean Whipple's decision to set aside Helder's conviction. The defense successfully argued that breaking the law requires actually enticing a minor - not enticing a Platte County deputy pretending to be a minor.

Damn courts, I wonder why the police even bother sometimes to just see these sh*tbags get let free, especially sex offenders. This scenario is no different that if a person bought/sold drugs that were phony or picked up a prostitute/john that was really an officer. Same criminal methodology, different category of crime. The intent was there to commit the crime against a MINOR... There has got to be case law on this, how many whack jobs have been locked up by the FBI, State, and Local police during internet stings where they contact a minor (officer :lol: ) and arrange to meet them.
