DA seeks release of convicted rapist because of new DNA evidence

BOSTON -- Suffolk District Attorney Daniel Conley has asked a judge to release a Boston man convicted in a 1991 kidnapping and rape, citing new DNA evidence.

Anthony Powell, 34, has been serving a sentence of 12 to 20 years at MCI-Walpole.

A 2002 test had already determined that DNA evidence did not match Powell, prompting a new investigation. On Friday, the Boston police crime lab notified prosecutors that the DNA did not match the 18-year-old victim's boyfriend either.

A hearing was scheduled for Monday to consider the state's request to release Powell. The state is expected to stay the execution of the sentence and release him on personal recognizance pending
