HARTFORD, Conn. (AP) - A Connecticut prosecutor has dropped a murder charge against a 28-year-old prison inmate accused of beating another prisoner to death in a revenge killing.
Prosecutor Herbert Carlson said in Hartford Superior Court on Tuesday that he could not prove that Waldemar Rivera meant to kill 34-year-old Kevin Cales on May 13 at the McDougall-Walker Correctional Institution in Suffield.
Carlson says the state will instead prosecute Rivera on a manslaughter charge.
Cales was sentenced in April to 79 years in prison for causing a car crash that killed five people in Berlin in 2006.
Rivera was related by marriage to 21-year-old Maryneliz Jimenez, who was Cales' former girlfriend and 1 of the people killed in the crash.
Rivera is serving a 7-year sentence for robbery.
