This part of Ch 140 states that if a licensed individual is not in direct control of his/her handgun, that handgun must be unloaded and in a locked case or trunk. My question here is what if you have a semi auto handgun that is cable locked and in a locked mounted case in the back of an SUV. If you also store a loaded mag in the same locked case, does the Mass law consider this handgun to be loaded even though the mag is out of the handgun? If it does, what if the loaded mag is not in the locked case, but somewhere else in the back of the SUV?

Trying to get a clarification on this.

As I recall from prior discussions with Chief Ron Glidden, MGLs do not have any special requirements regarding loaded mags located with a firearm or not.

But if you want the most definitive answer, give the expert a call at Lee PD during business hours and he'll tell you for certain.

If it is just a curiosity question and can wait for an answer, consider attending the free MA Firearms Law Seminar at Braintree Rifle & Pistol Club on Sunday, May 1st, 9AM-12Noon where Ron will be discussing just these sort of issues. See http://www.masscops.com/phpBB2/viewtopic.php?t=7422 for more details on this event.

LenS. Thanks for the reply. There isn't an urgent need to know. It came up as an object of discussion during a range session. The discussion became pretty large and heated at one point and I just thought this might be a good place to get clarification. I think I'll make a point of attending this session in Braintree. The more we know, the better of we are.

Thanks again.

The reason most of these discussions related to CH.140 become heated is simply due to the fact most of the law is ambiguous and/or vague and rambling, etc. etc.
Cops, hunters, and sportsmen in general are NOT lawyers. In so far as a magazine/clip/feeding device in proximity to a cable-locked "unloaded" firearm that is in a locked "storage device"....................

Why would there be any discussion?
