2 Quincy Police Officers hurt arresting suspect

QUINCY -- Two police officers were hospitalized Thursday after a shoplifting suspect with a history of violence attacked them in Wollaston.

Officers managed to arrest Brendan McGuinness, who is 34 or 35 years old, after the scuffle, which began outside CVS on Beale Street and spilled into the parking lot of the Wollaston Center T station across the street. Two alleged accomplices were also arrested, the police said.

Police Chief Robert Crowley said the incident began when McGuinness left CVS with stolen merchandise and an employee flagged down Quincy police officer David Levine, who was in a cruiser nearby.

Levine blocked the car carrying the trio. When the officer clamped one handcuff on McGuinness, the man ``gave him a forearm right above the right eye, causing a deep gash,'' Crowley said.

Detective John Menz, who was working a private detail, arrived shortly and caught up with McGuinness in the MBTA lot. Menz and other officers, who responded to a radio distress call, detained McGuinness. Menz hurt his ankle during the struggle.

Both officers are at Quincy Medical Center and Levine is expected to need several stitches, Crowley said.

McGuinness will be charged with assault and battery with a dangerous weapon (his boot), assault and battery on a police officer, resisting arrest and shoplifting, Crowley said.

A man and woman with McGuinness will be charged with shoplifting, said Crowley, who did have their names.

McGuinness was indicted in 2004 on charges he robbed a Holbrook pharmacy, stole a Jeep and drove the wrong way on Route 3 to try to avoid police. Police said he was armed with a knife when he stole OxyContin and Percocet from the Brooks Pharmacy on Route 37.

In 1997, while in state prison in Walpole for an armed robbery conviction, McGuinness pleaded guilty to a charge of assault and battery on a correction officer.

Officials testified at the time the assault occurred after they ordered a general room search and McGuinness was removed from his cell. He was taken into the shower room in handcuffs and leg irons, where he proceeded to turn on the water and block the drain, causing a flood in the segregation tier.

Lt. Daniel Lussier, then 44, took McGuinness into an adjoining room. He later told investigators that McGuinness became enraged and ``headbutted'' him. Lussier suffered a concussion and two broken teeth and eventually required surgery

QUINCY - A two-time prison inmate, notorious for his volcanic violence, hospitalized two Quincy police officers who tried to arrest him for shoplifting.

Brendan McGuinness, 35, split open one officer's head outside the CVS store in Wollaston on Thursday after the officer put handcuffs on one of the man's wrists, police said.

Bloodied, officer David Levine radioed for help just before 2 p.m. A detective working a private detail a block away chased down McGuinness as he sprinted across the nearby MBTA parking lot. The detective, John Menz, injured his ankle wrestling with McGuinness but managed to detain him with help from back-up officers, according to the police.

Also arrested were two people who were with McGuinness. David Dyer, 38, of 236 River St., Weymouth, is charged with shoplifting. And Marisa Agostino, 28, of 22 E St., Hull, is being held on warrants for violating court orders from separate crimes. A judge last year agreed to drop heroin and Ecstasy charges against Agostino if she stayed out of trouble until April.

The three were held overnight and scheduled for arraignment this morning in Quincy District Court.

McGuinness, who was released from prison in September, told police that he is homeless. The charges against him include assault and battery on a police officer, assault and battery with a dangerous weapon, for allegedly kicking the officer with his boot, resisting arrest and shoplifting.

McGuinness, who grew up in Germantown, is known to local police as being a hometown renegade.

His criminal record began at age 11 and he was incarcerated at juvenile facilities several times while a teenager.

In 1990, when McGuinness was 17, a Norfolk Superior Court judge described the teen's criminal record as ''the worst I've ever seen.''

The judge sentenced him to 20 years in state prison for robbing a parking attendant of $50 at gunpoint across the street from Quincy District Court.

McGuinness served most of his time at the maximum-security prison in Walpole. He spent 30 months in the heightened-security disciplinary wing for attacking a correction officer at the prison.

Lt. Daniel Lussier, the correction officer, testified that McGuinness head- butted him, knocking out two of his teeth and giving him a concussion. The officer needed surgery. A judge added six months to McGuinness' prison sentence.

McGuinness was released early but was returned to the prison in 2004 after being convicted of robbing a Holbrook pharmacy at knifepoint and leading police on a chase in a stolen car.

He was released from the state prison in Walpole in September, Police Chief Robert Crowley said, and he recently became what Crowley termed a ''person of interest'' in several Quincy crimes..

Crowley said a photograph of McGuinness was distributed to officers during a routine briefing on Thursday morning. He would not say which crimes McGuinness is suspected of committing.

Hours later, a CVS employee flagged down officer Levine, who was driving by the store at 42 Beale St., and pointed toward McGuinness, who was getting into a car.

Police said Dyer and Agostino had waited outside the pharmacy while McGuinness, carrying an old CVS receipt, went inside to make a fraudulent return. Crowley said a clerk refused to give McGuinness cash back for the items - razor blades and over-the-counter medication - which he had allegedly taken from the shelf.

''With that, he leaves the store with the items,'' setting off the alarm, Crowley said.

Levine blocked the car with his cruiser and ordered McGuinness to get out. With one wrist cuffed, McGuinness ''gave (Levine) a forearm right above his right eye, causing a deep gash,'' Crowley said.

Both injured officers were taken by ambulance to Quincy Medical Center and treated.

Life is about choices and the consequences of those choices. McGuiness is either incapable or unwilling to modify his behavior. He should look at his reflection if he is looking for someone to blame. There are people with far worse upbringings who did not grow up to be predatory scumbags.

McGuiness is a loser because he chose to be one- please deal with it.

Shoplifter who injured two cops sent to prison

A shoplifter who hospitalized two Quincy police officers trying to arrest him in February has been sent to prison for four years.

Brendan McGuinness, 35, formerly of Sumner Street in Quincy, was already in default on indictments of receiving stolen property in 2007 and assaulting a corrections officer at the state prison in Walpole in 2004 when police stopped his Buick on Feb. 7.

He was suspected of stealing razor blades and an over-the-counter drug from a CVS Pharmacy in Wollaston.

McGuinness pivoted, striking Police Officer David Levine with an elbow, splitting his head open and knocking him to his knees as the officer was placing him in handcuffs.

McGuinness ran to the Wollaston MBTA station where other officers caught up with him, but he continued to resist. Detective John Menz suffered an ankle injury during the struggle.

Levine returned to work this past week, and Menz is expected to return this coming week, Police Chief Robert Crowley said.

''McGuinness was well known to Quincy police,'' Crowley said. ''I agree with the way the district attorney handled the case.''

''McGuinness will be off the street for at least four years, and he won't be hurting any civilians or any more cops during that time," Crowley said.
McGuinness admitted his guilt on all three cases Thursday in Norfolk County Superior Court, the day his trial was supposed to begin for the 2004 state prison assault. Judge Elizabeth Donovan accepted the district attorney's sentencing recommendation.

McGuinness was given a 2½-year sentence on the Quincy case and a four-year sentence on the 2004 assault on the corrections officer to be served concurrently. A one-year sentence on the stolen property charge was suspended and he was given two years of supervised probation on his release from prison.

Two others who were with McGuinness in Quincy were arrested on shoplifting charges. David A. Dyer, 38, of 236 River St., Weymouth, pleaded innocent and is scheduled to return to Quincy District Court on April 30.

The shoplifting against charge Maria A. Agostino, 28, of 44 E St., Hull, was continued without a finding until March 3.

AMEN !!! - I have actually sat with Mr. McGuiness and had an intellectual conversation with him. He is an EXTREMELY smart man. He is a creative writer and a poet. I have read his work and it was all remarkable. The system grabbed him up as an example, chewed him up, and spit him out. He is a prime example of our f*cked-up and imperfect justice system. If it wasn't for that judge making an example of him when he was just a boy, he would most likely be a successful poet or writer by now !!!
