    The Springfield Patrolman's union endorsed Mastroianni during the election and feel he's stabbed them in back on several occasion since taking office. He was also endorsed by West Springfield PD and State Police so lets see how long it takes him to piss them off.

    CHICOPEE – Jurors in the police brutality trial of former Springfield police officer Jeffrey M. Asher were taken by bus Tuesday afternoon to view the Springfield street where Asher is alleged to have assaulted a man during a traffic stop.

    Asher is charged with assault and battery and assault and battery with a dangerous weapon in connection with the November 2009 arrest of Melvin Jones III, of Springfield, on Rifle Street.

    Prosecutor Elizabeth Dunphy Farris and defense lawyer Joseph W. Monahan III will give opening statements and testimony will begin Wednesday.

    Jury selection began Tuesday morning in Chicopee District Court and was complete by mid-day, when four men and three women were seated.

    In district courts, the deliberating jury has six members. One extra juror was selected in case for any reason a juror has to be excused during the trial.

    An amateur video of the arrest made public by The Republican and MassLive.com showed Asher apparently beating Jones with a police flashlight after a car in which Jones was a passenger had been pulled over on Rifle Street.
    Police maintained that the use of force came after Jones attempted to flee the scene and tried to grab an officer’s gun in the scuffle that ensued.

    Jones' injuries included damage to an eye, eye socket and face.

    2 Springfield cops defend actions of Jeffrey Asher in police brutality trial

    Two Springfield police officers who were part of the November 2009 traffic stop of Melvin Jones III took the stand Thursday and said former officer Jeffrey M. Asher used the correct amount of force on Jones.

    The prosecution in the police brutality trial of Asher, a former Springfield patrolman, finished its case early Thursday and the defense case began in Chicopee District Court.

    Asher is charged with assault and battery and assault and battery with a dangerous weapon in connection with the November 27, 2009, traffic stop of Jones on Rifle Street in Springfield. He was fired by Police Commissioner William J. Fitchett but was approved by the state for disability retirement.

    An amateur video of the arrest made public by The Republican and MassLive.com appears to show Jones, who is black, being held down by two officers while struck repeatedly by Asher with a large flashlight.

    The first two defense witnesses were Springfield Police officers Michael Sedergren and Theodore Truiolo.
    Sedergren had unsuccessfully applied for a criminal complaint charging Tyrisha Greene, the woman who videoed the incident, with illegal wiretapping.

    Police Commissioner William J. Fitchet had suspended Lt. John Bobianski and Sedergren without pay 45 days and officer Truiolo for 15 days after an investigation of the Jones incident.
    On the stand Thursday, Sedergren said he yelled for fellow officers to hit Jones because he was sure Jones was reaching to take his gun out of his holster.

    At that time, Sedergren said, he had an arm around Jones' neck and was holding his head down as Jones was bent over the hood of a police Ford Taurus.

    Sedergren said he never saw Jones go for his firearm, but he felt Jones grab for it.

    “I yelled for Officer Asher to strike the subject.” Sedergren testified.

    He said he told Asher, “He’s got my f—-ing gun. Smash him.” Asher started hitting him.
    “I honestly thought he was going to be able to get that firearm out of the holster,” Sedergren said.

    Prosecutor Elizabeth Dunphy Farris asked Sedergren how he thought Jones could reach for his firearm, given the position he had Jones in over the hood and given the fact that Truiolo was on his right holding on to Jones.
    Sedergren continued to say he was sure Jones was going for his gun.

    CHICOPEE – A District Court jury has convicted former Springfield police officer Jeffrey M. Asher on assault charges stemming from the arrest of Melvin Jones III during a Nov. 2009 traffic stop.
    The jury delivered its verdict shortly before 1 p.m. Tuesday. Sentencing was postponed to March 28 after a short hearing Tuesday afternoon.
    Asher was charged with assault and battery with a dangerous weapon (a flashlight) and assault and battery. He was convicted on both counts.
    Jurors began deliberating Monday after hearing closing arguments from defense lawyer Joseph Monahan and prosecutor Elizabeth Dunphy Farris.
    Just before 3:30 p.m. Monday, jurors asked Judge Maureen E. Walsh, "Can we re-hear the definition of the charges?" Walsh repeated her instructions on those points. Jurors deliberated for about another hour without reaching a verdict.
    The jury resumed deliberations this morning.
    Defense lawyer Joseph Monahan and prosecutor Elizabeth Dunphy Farris gave closing arguments on Monday. Monahan said Asher was justified in his actions because they were in self defense and defense of others. Dunphy Farris said Asher's multiple blows to Jones were excessive force and not necessary.

    The city's retirement board is scheduled to meet Thursday to consider stripping it from him.
    Asher was convicted last week of assault and battery charges for beating Melvin Jones, III unconscious with a flashlight during a traffic stop on Rifle Street in 2009. Prior to Asher’s conviction, he had been fired by the police department.
    Asher will be sentenced on March 28, and could face prison time.
    State law provides for the forfeiture of a public pension upon conviction.

    SPRINGFIELD - A federal judge excluded the city and its police supervisors from the next round of litigation related to the 2009 beating of a black motorist by former patrolman Jeffrey M. Asher, but signaled four officers could be in for a swift verdict and days of hearings on civil damages.
    Asher – who is white and a 17-year-veteran of the police force – was convicted Feb. 28 of assault and battery with a dangerous weapon in connection with bludgeoning a black motorist in the head and face with a metal flashlight during a traffic stop on Rifle Street, which was caught on amateur video by a neighbor.
    Asher faces jail time at his sentencing in Chicopee District Court on March 28. But meanwhile, the motorist, Melvin Jones III, has sued the police and the city in federal court for civil rights violations and use of excessive force – exposing Asher, three other officers present and the city to a financial settlements since Jones was blinded in one eye and broken facial bones.

    Convicted ex-Springfield officer loses pension

    SPRINGFIELD — A former Springfield police officer serving an 18-month jail sentence for severely beating a man during a traffic stop has lost his pension.
    The city’s retirement board voted 4-1 on Wednesday to revoke the $45,000 annual disability pension of Jeffery Asher, convicted in February of assault and battery with a dangerous weapon for using a flashlight to beat Melvin Jones III in Nov. 2009. Jones was beaten unconscious, blinded in one eye and had broken bones and teeth. The beating was caught on video.
    Board Chairman and police Lt. Robert Moynihan said the board acted in accordance with a state law that mandates forfeiture of a public pension in cases of "final conviction" of a criminal offense pertaining to the person’s job.

    Jones, 30, gained local notoriety after being beaten by former police officer Jeffrey M. Asher during a traffic stop that was caught on videotape in 2009.


    Officer Richard Rodrigues said the incident began about 5 p.m. when Jones arrived at the Fort Pleasant Avenue home to pick up the two children.

    When Jones returned to the apartment at 10:30 p.m., he allegedly told the woman that “the devil is inside me” and threw her against a wall in front of the two children and then punched her with a closed fist, said Rodrigues, citing the police report on the incident.

    Jones then took his son and left the scene in a silver car, accompanied by a female, Rodrigues said.

    Chicopee police arrested Jones in their city at about 3:30 a.m., Rodrigues said.

    The woman was taken to Baystate Medical Center and the children are in the custody of the state Department of Children and Families.

    Jones, in an unrelated matter, bailed out of a plea deal on a drug trafficking charge in Hampden Superior Court, according to lawyers involved in the case.

    Hampden District Attorney Mark G. Mastroianni said Jones refused a pre-negotiated plea deal pertaining to that case.

    “I honestly don’t know why,” Mastroianni said after the court hearing earlier this month.

    Jones was charged with cocaine trafficking in 2010, the third in a string of crimes he is accused of committing after the highly publicized beating.

    Jones denied the charge during his arraignment today in District Court. The bail on the 2010 case was revoked and defense lawyer Steven A. Nison said that Jones could be held in jail for as long as 60 days.

    Bail on this current case was set at $2,000 and Jones is due back in court for a pre-trial hearing on Aug. 21.
    Jones, in an unrelated matter, bailed out of a plea deal on a drug trafficking charge in Hampden Superior Court, according to lawyers involved in the case.

    Jones’ defense lawyer, Jared Olanoff, said his client now wants to go to trial. A trial date has been scheduled for Oct. 23.

    Jones is slated to be arraigned on the domestic assault and battery charge today.

    City of Springfield settles with Melvin Jones III for $575,000

    The city has reached a $575,000 settlement in federal court with Melvin Jones III, a black motorist beaten by a former police officer during a 2009 traffic stop, an attorney for the city said Wednesday.
    John Liebel, a lawyer for the city, said the settlement was made public today and followed a two-day mediation in U.S. District Court before Magistrate Judge Kenneth P. Neiman. Jones sued the city and police for civil rights violations, negligence and assault.
    "It was a good settlement because it was less money than the plaintiffs wanted and more money than what the defendants wanted to pay," Liebel said. "This was a significant expenditure for the city, but in light of the multi-million dollar exposure we faced, had the case gone to trial, and the fact that it was a divisive matter in the community, the city felt it had to put this case behind them."
    He added that the payment was split into two components: $275,000 to a structured settlement company and $300,000 to Jones' lawyers.
    The Jones beating by former police officer Jeffrey M. Asher -- who was convicted of assault in connection with the incident and sentenced to 18 months in jail -- was caught on amateur video.
    Jones has also had a string of legal problems including separate arrests for shoplifting, domestic assault and cocaine trafficking. Jones is being held behind bars without bail in connection with the drug and domestic assault charges.
