The judge should be the pivot man in a gang related circle jerk, so I speak of the intial stop only. If the reason for the stop was trespassing on private property, then the cop should have articulated that and even cited (warning or money) for trespassing on private property with a motor vehicle. Stopping someone just because he/she didn't look like he/she belonged is a no-go. Every judge thinks everyone is innocent, and I suppose rightly so. We need specific and articulable facts to stop a MV. And don't forget, we're not allowed to use a MV stop as pretense to get into a car... Yah, MA makes it fun.... Hell, if I stopped every shitbag that didn't "look right" or "belong", I couldn't drive 5 feet...
Pretty much line for line out of the drug interdiction manual Tactics for Criminal Patrol. No matter what the indicators, base your stop on a MV violation in case that the stop is challenged.....and oops look at that, I have floated into the deep end of the pool and am officially out of my depth! Another reason to always remeber what the good Capt. Ray Eugenio told thousands of recruits, "chapter 90 is your friend".
