Mass LTC Question

    I was just offered employment by a College Police Department and I need to renew my LTC because I had no use for a current one since I wasnt in Law Enforcement anymore. It just recently expired a few months ago 7/2012. I was wondering if anyone knew if an Special State Police Officer can carry on the badge and secondly can a College Police Department process my LTC, I know the department I use to work for could of processed my LTC, instead I had in done in my hometown.

    I believe it has to be through your hometown police dept. unless you own a business in another town.

    LTC is a requirement of SSPO.

    Can get an LTC through the city/town you live in, city/town you own a business in, or your employer can give you an LTC if they're an issuing authority.

    You have a 90-day grace period after the expiration date on your LTC, which is now either expired or about to expire. You cannot carry "on the badge" as an SSPO.

    Good reminder to check your DL and LTC expiration dates. I was a week into my 90-day grace period when I realized my LTC was expired (I've since renewed it).

    The grace period I believe is only good if you submit prior to expiration . Then you would be covered for an additional 90 days. My issue was I had no need to renew my ltc , so I didn't . However now being offered employment I need to renew it and my local pd said their booking into middle of November for processing dates but I'm going to see the Lt who I know well and ask if there is anything that can be done . The lady told me I might not get my license till march 2013 but I think that's bogus. I just hope I don't lose the employment offer, I did put a note on my app saying upon employment I would renew my ltc,I just had no just cause to renew it because I wasn't in law enforcement any more.

    No, it's a 90-day grace period, regardless of when you re-apply. Like I said, My LTC was a week expired when I applied for my renewal, and it went through with no problem at all.

    not sure how it's done with SSPO, but at the prison we could carry "on-duty" and return the issued sidearm at the end of the shift.

    maybe until the permit clears ?

    Just renewed my LTC-if you let your LTC lapse you are required to start over from square 1 that means safety course, BOP, etc. Hate to disagree with you Delta, but was told at my Licensing authority once it's exp its exp and The newest version of our Draconian LTC process does allow for 90 grace if you have put in your paperwork before your current LTC expires. BUT my LTC Authority is Boston and we all know Mumbles is thisclose to Loonberg in NYC in his efforts to disarm the legal population! Soooo...

    Licensing Authority may or may not honor that grace period, based on which way the wind blows. However, if the law dictates a grace period, then it's the law. If you have a letter of conditional offer of employment, just show that to the PD who will be issuing your license. This shouldn't even be a question. It's common sense. NO you are not covered by HR 218 under the LEOSA. Stop wasting your time, and go right down to the PD and get that ball rolling. If you want that job that is.

    Not as a method of carrying on duty, but if he's working for one of the State schools it most certainly does permit out of state off-duty carrying once he starts working.

    The employer requirement is "an employee of a governmental agency", which certainly applies to the state school cops as they're state employees.

    Sheriffs, deputy sheriffs, and corrections officers can carry "on the badge" by statute, MGL 147-8A;

    147-8A

    Section 8A. A sheriff, any of his deputies, and any officer of any institution under the supervision of a sheriff if so authorized by him, the commissioner of correction, and the deputy commissioners and any other officer of the department of correction or of any institution under its supervision if so authorized by said commissioner, the chairman of the parole board and any other officer of the parole board if so authorized by said chairman, and the penal institutions commissioner of the city of Boston, his deputy, and any officer of any institution under the supervision of said penal institutions commissioner if so authorized by him, may carry revolvers, clubs, handcuffs and twisters and such other weapons as are necessary in the performance of their duties.

    No such provision exists in MGL for SSPO's.

    So if that is the case, then how does HR 218 cover or not cover a CPO or SSPO?

    Most SSPO's aren't employed by a government agency (a requirement of the LEOSA) and corrections officers aren't tasked with making arrests (another requirement of the LEOSA).

    515 CMR 5.04
    (6) Carrying of Firearms by Special State Police Officers.
    (a) A special state police officer employed by any agency
    shall not carry a firearm on duty unless the officer
    complies with 515 CMR 5.04(7)(b), (c) and (d).
    (b) The special state police officer shall successfully
    complete a firearms training instruction program as
    approved by the Colonel.
    (c) The special state police officer shall have been issued
    a license to carry firearms in accordance with M.G.L. c.
    140, s.131.

    Are deputy sheriff's covered by LEOSA due to the fact that they are "Vested with all police Powers Provided By Law"?

    Also, can a sheriff, (if they wanted), issue LTC?

    If they carry a firearm in the performance of their duties, yes. A guy behind the wall who's a deputy and doesn't carry a firearm and train and qualify with it: no.

    I believe the department also swears their officers in as deputy sheriffs in the county their located in. Does this help me at all ?

    You could always post the name of the interested college. I know dozens of members here who would jump at the job. Not to flame you, Daniel, but you have lots of other options right now or something?
