Car Accident Today

    I was in a car accident this afternoon , i approached a four way intersection going left in (Stoughton,Mass) with a solid green light( no green arrow at the time) and i came to a comeplete stop, looked for

    oncoming traffic, no traffic going straight, so i proceeded to go slowly until it was safe to go (i did yield) i was approximately 1/2 way through the interestion and at this point i'm vulnerable

    to a grey minivan that came flying through said intersection and clobbered me on my passengers side door and passengers side back door , he spun me into the

    oncoming lane of traffic, i came to a stop , i did not have my seatbelt on ( i wish i had it on i ended up with a nice gash on my forehead ) the airbags did not deploy

    and police,fire and ambulance arrived on scene and i was taken by ambulance to the hospital where i went through a bunch of tests ( MRI, X-Ray,CAT Scan all were

    Neg ) this is to the best of my knowledge as to what happened today , am i at fault for this ?? I would appreciate any advice and / or comments anyone may have.Thank you.

    Which direction (in relation to the intersection) did the other vehicle come from? Did it also have a green light?

    If you make a left turn in front of oncoming traffic, you're at fault about 99% of the time.

    I'm not sure exactly what direction he was headed in asfar as north or south but he was coming right at me , like i said he was F#$%^ flying through that interesection, yes the other vehicle had a green light unless he had the red and ran it..!

    All the insurance company needs is to find you 51% at fault to charge your deductible and surcharge. At that point, you're rates are going up. Good luck.

    Don't know / don't care. The police never determine fault.

    Have fun battling your insurance company and the Merit Rating Board for the next two years though!

    You did not yeild, as is evident in you cutting in front of another car's straight travel path.

    While I found your sensationalized verbiage such as "vulnerable", "flying", "clobbered" and "he spun me" wholeheartedly exciting, and I mean to the point in which I had to crack open a beer to help me calm my nerves, the fact of the matter is you turned in front of a vehicle who had the right of way.

    I'd smoke your azz with a citation, and it is also very likely the insurance company would find you at least 51% at fault.

    In the end, the only thing I'd care about is how god damn annoying crash reports are to fill out.

    It's actually brutally honest. If you want people to sugar coat things you're in the wrong place. That being said feel fortunate you're OK and expect to be sued by the other driver.

    Get sued , it will NEVER happen because my feeling is we will both be 50-50 at fault - if the dumbass wasn't speeding and i didn't travel into his path we wouldnt be having this conversation now would we..?

    Come on now, you've been here long enough to know how this was going to go. You should have seen that one coming even if you didn't see the gray minivan (sorry couldn't resist :teeth_smile:). If you were an unregistered guest or a noob, you know it would have been much worse.

    It doesn't matter what you feel. The insurance company is going to spank you on this one. I just got hit by some idiot who pulled into traffic and hit the rear passenger side of my car (door to bumper) with the front of her car. The insurance company is still trying to determine fault even though I was in the only travel lane heading in that direction. I know it was her fault, but it's ultimately up to the insurance. I also know that they like to go 50/50 and there is a chance that they will find me at fault if they believe her story more than they believe mine. Although I still don't know what red light she thinks I went through as the light and intersection were a good 100-150 yards up the road. Anyway, I won't be surprised if the uninjured at fault party goes to her Brazilian chiropractor and Spanish speaking lawyer and tries to sue me. It will piss me off to no end, but it really wouldn't surprise me. Whether the other party has a valid case or not, win or lose, it's going to be a major pain in the ass. So don't ignore the possibility just because you think they were equally at fault.

    OK, it may be that I am not understanding you correctly... but if you had the green light, why come to a complete stop before making the turn? If there is no oncoming traffic, I don't often... if ever... see motorists come to a complete stop when they have an opportunity to make a left turn with the green and no oncoming traffic. I've worked plenty of left turn accidents, it's a common type. My guess (that's all it is since I'm not there to see the evidence) is that if your airbags didn't deploy, then you weren't hit that hard. That would indicate no excessive speed on the part of the other driver.

    FWIW, my next door neighbor was passenger in a sedan driven by her newly-licensed daughter, who turned left on a solid green on a divided 4 lane road, speeds running around 50-60 mph. They had the same type of accident and not only did every airbag in the car deploy, but it almost killed the mother. Fractured ribs, punctured lung, concussion, etc. I looked at their vehicle afterwards and the frame was bent, the dashboard was compressed into an upwards V shape in the middle, etc. Lots of indicators of the speed of the oncoming car.

    As others have said, police don't determine fault, just violations. Courts and insurance companies do fault. Glad you're OK. Glad it wasn't worse.

    Like others have said, you turned in front of oncoming traffic, you will be found at fault. Also if the other car was "flying" as you stated, then why would you turn in front of it. Since you were able to determine its speed just prior to impact, then you should have been able to judge its speed as it was approaching you before you turned. And 9 out of 10 people don't ever believe they are at fault at a crash (thats my stat) not even the person who rear ends someone at a red light. THey always have some kind of excuse.

    Your insurance company will make a determination of fault as will the other drivers. You both could hold a percentage of fault, which sounds like the case based on the point of impact you described. Being "at fault" in Massachusetts means you are 51% or more responsible for the accident and your insurance would have to pay whatever percentage of fault you hold. If the other driver is less 50% at fault, his insurance owes you nothing for your damages- if you had an injured passenger, that's another story. If the other driver had the right of way, you're more than 50% at fault, sorry. You can always appeal the surcharge if you disagree.
