Vile assaults on guards: Correction officers say inmates free to attack with bodily fluids

A total of 51 Massachusetts correction officers have been assaulted by convicts in state prisons this year, and the highest number of attacks came by inmates using bodily fluids, according to Department of Correction statistics.

But convicts who attack guards with urine, feces, spit or other “unknown liquids” are rarely prosecuted, infuriating officers who feel an automatic five years should be added to an inmate’s sentence. A bill that would require that, Senate Bill No. 1324, is pending.

“It may sound like a minor assault, but a lot of these inmates have hepatitis, AIDS, and our officers are getting hit in the mouth, in the eyes,” said Ken Ferullo, vice president of the Massachusetts Corrections Officers Federated Union.

“It is a major public health issue and one that affects officers’ entire lives, their families.

But the district attorneys are refusing to prosecute these cases,” Ferullo said.

Last week, one guard, Lt. Jan Modzeleski, attempted to file a criminal complaint in Wrentham District Court against an inmate who pelted him with bodily fluids in July.

Lt. Modzeleski and four other guards were attacked by inmates who threw hazardous fluids at them during the emergency predawn move of some 100 prisoners from Walpole’s “supermax” disciplinary disorders unit. They were relocated because of defective doors that allowed violent cons to escape their cells. But none of the cons was charged criminally in the attacks, and the court clerk refused to file criminal charges last week.

MCI-Cedar Junction in Walpole is one of four prisons covered by Norfolk District Attorney William Keating’s office. Keating’s office has also declined prosecution in Modzeleski’s case, union officials said — an accusation the DA’s office denied. “We do not decline to prosecute assault and battery on corrections officers,” said Keating’s spokesman, David Traub.

“Assault and battery on a corrections officer cases are prosecuted as serious crimes,” he said.

Thank You, I agree. Please call your rep on support of Senate Bill No. 1324. Altough I think the numbers of 51 are understated because I know of a couple of dozen of CO's just at my place (SBCC) that have been assaulted with urine alone this year with the DDU moving to our place.

Gate, I talked to Jan yesterday and he told me the Herald reporter screwed up the numbers (SHOCKING!!!). It was actually 51 co's were assaulted in the month of August @ MCI- Walpole. Best of luck to all in the law enforcement world and be safe. Gate give me a call I have wed/thurs off this week.

What a disgrace the Commonwealth of Massachusetts is.Lt. Jan Modzeleski is a stellar officer and a former US Army Ranger and veteran of the invasion of Panama (Operation Just Cause).These scumbags should be prosecuted within the fullest extent of the law."Pissers and shitters" are the worst for a CO to deal with.

no surprise... keating is a democrat. - and yet some of you criticize Gov Romney !!! Romney would sign a bill sanctioning mandatory on and after sentences for any inmate that assaults a correction or police officer - and you know it - its the flaming liberal dummycrats like keating and publicity hound tom reilley that cry for the pedophiles and other scum. It's time for you to wake up the ignorant guys who criticize Romney - tell them to look at the facts - 99% of all criminal sympathizers vote democrat - open your eyes and ears - stop voting for these ignorant and arrogant democrats - facts are facts- look at their history !!

I say, I say, I say again... Romney is no friend to the DOC or LE. Any Republican Governor who allows the DOC Commissioner to run the States Prison System in to the ground shouldn't be in office, or potentially running this Country.

The State Prison System is in amuck. Assaults on staff, other inmates are through the roof.

Throwing your own (possibly infected) waste at someone because you're frustrated to be in a place that is a result of you're own anti-social, criminal actions. I believe Sgt. Grunt; I cant imagine there is anything worse in the day of a Correctional Officer than to have to deal with a savage throwing his own shit at you. That is beyond reprehensible and disgusting.

The penalty cant be harsh enough for these jack-asses..
