Man indicted after officers are hit by car

WORCESTER -- The man accused of hitting two Bellingham cops with his car in September as he tried to avoid arrest will soon face a Worcester Superior Court judge on several charges.


David W. Mitchell, 50, was indicted by a superior court grand jury Friday on five charges, according to Worcester District Attorney John Conte’s office.


They include: operating to endanger, operating under the influence of drugs, resisting arrest and two counts of assault and battery with a dangerous weapon. An arraignment date has not been scheduled yet.


Mitchell had faced 14 charges, including assault with intent to murder, in Milford District Court for the Sept. 1 confrontation. These are expected to be dismissed following his superior court arraignment.


Mitchell allegedly hit Officer John McLaughlin and Officer Ken Jones with his Saab after they approached his parked vehicle outside the Countryside Motel on Rte. 140 and tried to back away, police said. The officers had gone to the motel to arrest Mitchell, who had been living at the motel, on an outstanding warrant for drug offenses.


The officers shot several rounds after Mitchell hit them and drove all over the motel lawn, but Police Chief Gerard Daigle said the exact number remains under investigation. His department is still awaiting the ballistics and accident scene reconstruction results to determine if the shots were justified.


Mitchell is being held without bail on the outstanding default warrants.



None of those charges shoud have been dropped! That and there should be no debate about weather or not the use of force was justified....It is clear that the ass clown attempted to murder two fine officers and they defended themselves!
