Condo Complex Bans Live Christmas Trees

Trustees Say Trees Pose Fire Hazard

PEABODY, Mass. -- Outraged residents of a Peabody condominium complex say a Grinch has ruined their Christmas and violated their religious rights.

They're upset the condo association is forbidding them to put up real Christmas trees and lights. Board members said that it's all in the name of safety.

Residents of the Ledgewood Condominiums received a notice that permits only artificial trees and ornamentation within each unit and forbids lighting on any live plants.

Some residents say they resent the fact the three trustees never held a meeting to discuss the issue with them.

"I decorate my house. And now they're telling me I can't bring in a real tree? I've always had a real tree. It's just not right," resident Louise Malacaso said.

The complex suffered a major fire two years ago that caused $1 million in damages. In their notice, the trustees said that another fire would be devastating and would make their ability to obtain insurance a mountainous task.

Trustees said that they will impose a fine of $100 a day on anyone who defies the ban.

This kind of crap really pisses me off. It's one thing to live in a community with rules, its another when the "community leadership" can just enact rules and regulations at will, without input or consent from the residents. I'd put up my Christmas tree and let them take me to court for the $3,800 fine. (I usually have my tree up from Dec. 1 until Jan. 7)

I'd be damned if after paying an arm and a leg to live in a condo, that the 3 bozo's would tell me what I can or can't have inside my own 'home'. I'd take that notice and use it for toilet paper.

I would support all you thought but I lived in a condo complex in Canton and some people just dont care about safety and leave their lights on all day which could result in a fire. Solution buy a house if you dont like the rules

I will fly the flag of my country, display holiday specific decorations, and even say Merry Christmas to people that aren't catholic. And if you don't like it, that's your right. My rights say I can do what I just stated. So kiss my ass. Stupid PC world we live in.

Okay, so you pay $150,000 to live in this condo, and 9 months of paying this morgage (plus condo fees) three dimwits send a notice to your place saying, "No Christmas Trees." Ok, yeah, I'm going to be able to just offload my condo, get a second morgage and move... all because three "trustees" decree a new rule. Sorry. Nope.

So what. Send me a fine. I wouldn't pay it. What will they do? evict you from what you own?

Yeah, I think your morgage can be forclosed on for non-payment of condo fees. Your condo fees pay for such things as snow removal and upkeep of the common areas.

Quote:
1. Unpaid Condo Fees: There are many reasons why owners get into arrears on condo fee payment. For some, it's temporary financial difficulty, which can happen to any of us. For others however, it's anger given dissatisfaction with the perception of how Property Management or The Board handles a problem of their concern; ergo, it is somehow believed that nonpayment of condo fees will motivate the The Association to be more responsive. The reality: Nonpayment of condo fees only hurts the causes of those who don't pay them, especially if their concern is for repairs covered by our emergency reserves or Master Policy, funded by ... guess what ... receipt of condo fees! Nonpayment hurts your neighbors as well. The costs for collection and legal actions on unpaid condo fees get passed to everyone through increased fees; i.e. we all pay for those who are either irresponsible or otherwise cannot remain up-to-date. On occasion, we also have to levy special assessments to compensate for budget deficits to effect emergency repair projects. If you're not paying your condo fees 'on purpose,' be assured you'll get more attention from The Association, but perhaps not the type of attention you desired. We all have to pitch in, be responsible; take care of ourselves and take care of each other.

I dont think a fine if the same as a condo fee, maybe im wrong.

Yes, condo associations have the legal right to make damn near any rules they like, AND enforce them with fines, foreclosure and evictions!

As a Constable, I have had to serve such notices to people, fining them thousands of dollars for "violating" some mickey mouse rule. If push comes to shove, yes they can evict you and someone like myself shows up with a locksmith, mover and detail police officer (if needed to keep the peace) and your goods go into storage and your ass goes into the street.

I evicted a lady ( house owner) who stopped paying her mortgage, She refused to vacate the house or open the door for us, she called the police (saved me the bother) and was taken away in silver bracelets to face a judge for criminal trespass (failure to vacate per court order)!

When you buy a condo, you really have NOT bought anything! It's just like an apartment in the way that they can make/change/enforce rules on your or evict you for disobeying.

I never want to live in anything but my own home. I don't need a bunch of busybodies telling me what to do and what I can't do. YMMV
