Main Page Mandatory Detail Officers @ roadwork?

Does anyone have a specific M.G.l. or CMR which explicitly states that a police officer is required to work when roadwork is occurring in the roadway (from minor work such as painting lines to major work with holes in the road etc.)?

Our chief seems to think it is OK that roadwork continues without detail officers.

We don't have a specific M.G.L. or CMR but we have it in our union contract that states any kind of work involving road blockage(any blockage including sidewalk blockage that may interfere with traffic) must have a detail officer present. All town dept's (water-sewer,highway) and 3rd party (gas/electric/cable) receive a copy of our details (from contract) so they are well aware of it. If no detail when needed either they get one or job gets shut down.

I remember from the academy Pat Rogers handing out some sort of paperwork and he said, "This is where you get details from." It had something to do with weight of vehicles on roadways but I cannot, for the life of me, find that paperwork.

look into town by-laws. most likely you will find an old by-law saying something like no one except officers of the town shall block streets or sidewalks. Also look intothe permit process of the town. most times there will be something asking if a police detail is needed.

One of the Sergeants on the department I work for has a great line for the companies that feel they can use their own guys as flagmen. The tree company was blocking the lane and their nit wit was waving a flag, the Sgt. comes around and lets them kindly know, "We don't do trees, you don't do traffic", your getting a detail ordered for you. In many towns Chief of Police or Board of Selectmen, through the construction permit process, has the say on whether a road can be shut down and what is required of detail officers.

Around here in the 'burbs, most of the landscaping companies could be required to hire a detail!

They tend to block almost a full lane in front of houses with their equipment and act like they own the road. Literally some of our major roads are narrow enough that traffic becomes one way, one side at a time due to these guys.

Once our chief disbanded the Special Police, he let lots of roadwork go with no details. If officers were unavailable, refused it or had exceeded their mandatory OT policy (rather restrictive, arbitrated and chief won), there was nobody at these jobs. More recently he's giving work to out of town officers, sheriff's department, etc. when his FT POs aren't available. A couple of FT POs retired and were appointed as Special POs so that they can work details. A selectman told me that they are having trouble finding Special POs here. Last I knew, the BS that the chief had them go thru might account for that, don't know what is really going on here.
