Homeowner Shoots Officer

DAYTON, Ohio -- A Dayton police officer is forced to take a trip to the hospital after being shot while handling a routine call. Police Chief Richard Biehl said the officer, who he identified as Officer Herron, and his partner were sent to the 200 block of Henry Street just after 1 a.m. Monday.The officers were checking reports of a possible breaking and entering to some homes that are vacant in the area. Police said Herron's partner went around the back of the homes while he went up a narrow three-foot wide walkway between two homes. Biehl said at that point, "an individual who was inside came out the side entrance and fired one shot and struck Officer Herron in the right shoulder".Herron's partner ran up from the backyard and ordered the shooter to drop the weapon. Police said the 72-year-old Trotwood resident immediately obeyed the order, dropping the gun and then sitting down and being taken into custody.Dayton Fire Department paramedics arrived to treat Herron's gunshot wound. Police said the bullet missed Herron's protective vest, and went right through the meaty, muscular part of the shoulder. He was taken to Miami Valley Hospital, where he was treated and then released within a couple of hours.Detectives took the shooter to downtown Dayton and the Safety Building to interview him. Investigators say it appears the man is the owner of the two side-by-side vacant homes. They also said it appears someone broke into the homes recently and stripped out metal pipes , possibly for resale on the black market. Police believe the homeowner wanted to stop the scrappers if they came back and that's why he was in the homes Sunday night and then Monday morning.Dayton Police Chief Richard Biehl said the shooting looks like it's due to a case of mistaken identity on the part of the homeowner. "I will just say that it was his perception that the individual that burglarized the homes had returned and that's why he fired a shot".Investigators said it's possible the 72-year-old may be arrested and charged but right now they continue to gather more information. Police said they also consider it extremely fortunate that Officer Herron did not get hurt more seriously and they also praised Herron and his partner for restraint in handling the incident without firing their weapons.
