MIDDLEBORO — A town employee accused of raping a child in 2003 is scheduled to return to Wareham District Court on July 18, but his attorney doesn’t expect him to show up. That’s because the Middleboro Gas & Electric lineman, Frank L. Place, 28, of 100 Old East Grove St., expects to be indicted by Brockton Superior Court. His attorney, Scott D. Bradley of Braintree, said there’s no evidence, no witnesses and no DNA in the case, and Place says he’s not guilty. “Waiting five years is pretty amazing,” Bradley said. “I don’t know how the DA expects to prove this.” Bradley described Place as a “nice guy” with absolutely no record. “The girl has issues in her life ... his only history is of being a nice person, and now all that’s taken away,” he said. Bradley expects Place to be found not guilty, but said there is no recourse to a false charge. “The only thing he can do is stay strong, go to trial, be found not guilty and move on with his life,” he said. According to court records, the victim was the younger sister of a woman Place was dating. The alleged rape took place at the sister’s apartment in December of 2003 when Place and the victim were set to go Christmas shopping after school. During a hearing with a team from the Plymouth County district attorney’s office, the victim said Place was taking her to the mall to buy her sister a Christmas present. The victim, now a high school junior, told investigators after they left the mall, Place took her to Massasoit State Park in Taunton and forced her to perform sex acts until another vehicle pulled into the area. The victim said the ordeal with Place had been bothering her for some time and just before Mother’s Day, while at the mall with her sister, she broke down and told her what happened, according to court records. The family confronted Place at his apartment on South Main Street, and according to court records, he apologized, saying he was sorry for what happened. Place’s attorney said he never admitted to the rape. Place was arrested by Detective Timothy G. Needham on May 15 and charged with rape of a child with force. He is being held in the Plymouth House of Correction on $10,000 bail, with the stipulation if he comes up with the cash he’ll wear a GPS ankle bracelet and be under house arrest. Middleboro Gas & Electric Department spokesperson Sandra A. Richter confirmed Place works for her department, but declined any further comment.
