LAPD Investigate Officer Who Kicked Alleged Gunman

LOS ANGELES --
Los Angeles police are investigating the actions of an officer who kicked a man in the head while trying to wrestle a gun out of his hand, it was announced Tuesday.
The confrontation occurred in the Hollenbeck Division on May 9 when Rudy Doria was crossing Huntington Drive, according to a Los Angeles Police Department statement.
Officers Gabriel Gaxiola and Carlos De La Cruz stopped the patrol car to approach the suspect, when he began running.
Doria pulled out a semiautomatic pistol from his waistband but lost it when he tripped and fell to the pavement, police said. The pistol landed several feet away.
As Gaxiola approached Doria, he kicked the suspect to prevent him from recovering the weapon, police said.
The weapon was loaded, according to police.
Doria was treated for minor injuries.

I don't see what there is to investigate. The guy was going for the gun he dropped, he's lucky to be alive...

I'm guessing some "bystander" made a personnel complaint when they saw the officer kick the guy. When someone wants to make a complaint, we're obligated by policy to investigate it, especially when it involves potential excessive force. Hopefully this won't go anywhere.
