Boston City Ordinance

Is the city ordinance for Drinking in Public arrestable. I realize it carries a $200.00 fine, but could not find any info on the right of arrest. If not could it be covered by 272:59.

There is another ordinance that says a PO may make an arrest of someone willfully violating any ordinance.

I remember being a Muni and knowing that a violation of any park rule & reg constituted trespassing. "Sir, your feet are on the park bench in violation of Boston Park rules & regs. Take those gunboats off my bench or I'll lug you for trespassing."
D.P.W. and the Big T was a ticket to many a court complaint or hearing and still is.

Im pretty sure the city ord states that it must be an open container on a public way. 272.59 gives power of arrest on a public way for any ordinance.

Drinking in Public is arrestable but the officer has the right to issue a City Ordinance Violation (Fine). Most officers will arrest for this offense if the suspect acts up.
