WORCESTER— Police are investigating the slaying of a Westboro man whose body was discovered yesterday morning slumped over the blood-soaked seat of an expensive BMW parked on Florence Street.

The slaying, the first in the city this year, appears to be drug related, according to police.

Jack A. McGuire, 35, of Westboro, was found with a stab wound in his upper left leg.

In a news release authorities said, “Detectives are attempting to look into the clear motive but it appears at this time that it may be drug related.”

Maria Escoto of 10 Florence St. was about to go to work yesterday morning about 4 a.m. when she noticed a gray 2003 BMW 745Li blocking a portion of her driveway.

It was the same car that was parked there three hours before.

She called police, and when officers arrived at 4:18 a.m. they found Mr. McGuire dead in the front seat and saw a pattern of blood from the front passenger door around the car to the driver’s side door.

Luis Hernandez, 17, said his family first thought the man inside the car had been at a party on the street and was sleeping. They found out after police arrived it was much worse.

“We don’t know what he was doing there,” Mr. McGuire’s aunt, Karen B. Reimann, said yesterday when asked if she knew why her nephew was in the city. She answered the phone at a family home in Sudbury where Mr. McGuire recently had been fixing up the lawn.

Ms. Reimann, of Maynard, said her nephew was in his girlfriend’s car. The girlfriend called family yesterday morning to tell them what happened.

“She called my brother this morning and said they found him in the car,” Ms. Reimann said.

Investigators said there was no immediate indication Mr. McGuire had ties to anyone living near where the car was parked.

Detectives remained at the scene through mid-morning, with a section of Florence Street, near May Street, bordered by police tape. Detectives interviewed neighbors.

“We don’t believe this was a random act,” Detective Sgt. Gary J. Quitadamo said. “We’re still working around the clock. We’re conducting our investigation.”

Members of the Police Department crime scene unit checked the BMW yesterday, collecting evidence.

“The scene was processed and the victim’s vehicle was towed to the Worcester Police Station for further investigation,” the news release said.

Ms. Reimann said her nephew grew up in Framingham and Sudbury, going to high school at Lincoln-Sudbury Regional High School.

Janice Serrano, 16, who lives near where the car was found, said the neighborhood is usually quiet but there have been gang fights at times.

“I was kind of surprised,” she said. Serious crime doesn’t happen much on her street, she said.

A group of neighbors huddled around the crime scene said they didn’t hear anything yesterday morning. The driver’s side mirror of the car had been broken.

Police are asking anyone with information about the case to call detectives at (50 799-8651.

Drug slay suspects denied bail

Botched ripoff alleged

By Scott J. Croteau TELEGRAM & GAZETTE STAFF
scroteau@telegram.com

WORCESTER— The plan, according to investigators, was to pull a phony gun on a drug dealer and take off with his crack cocaine.

'It backfired, quickly and fatally, when the dealer and two friends fought back early Monday morning near a car parked on Florence Street.

'Jack A. McGuire, 35, died at the scene, apparently stabbed to death with one of the knives he had with him in the car he was driving. Some 24 hours later, the three people he had fought with that morning were in custody, later to be arraigned on murder charges and ordered jailed without bail.

The body of Mr. McGuire, who lived in Westboro and Sudbury, was discovered at 4:18 a.m. Monday, slumped over the blood-splattered front seat of his girlfriend’s silver 2003 BMW 745Li. The car was parked in front of 10 Florence St., where police had been summoned by a resident complaining about a suspicious car blocking her driveway.

Officers arrived to find the man’s left leg covered in blood and a blood trail leading from the passenger side of the BMW around the front to the driver’s side door.

Piecing it all together, authorities believe that Janleer Povez, 28, was the drug dealer whom Mr. McGuire eventually met up with Monday morning and who fatally stabbed him. Police identified the two who allegedly assisted Mr. Povez as April Marlborough, 26, and Lance Savage, 37. All three suspects were described as transients with no permanent addresses.

Assistant District Attorney Lawrence J. Murphy said the slaying, the city’s first in 2008, was a joint venture by the three suspects.

Police and prosecutors say their case started to come together quickly, after investigators interviewed Mr. McGuire’s girlfriend during the day Monday.

Mr. Murphy said the girlfriend told police that Mr. McGuire had left her Westboro home around 12:15 a.m. Monday and headed to the city, where he planned to rob a crack dealer at gunpoint. There were knives in the car and police believe one of those knives was used to kill Mr. McGuire, a laborer who had recently been laid off from a job. Mr. McGuire allegedly called Mr. Savage and met up with him in the city.

Detective Capt. Edward J. McGinn Jr. described Mr. Savage as a drug user and an “agent” for drug dealers who usually hangs out in Main South, attempting to make contact with people looking for drugs. He allegedly brings people to drug dealers and, in return, gets drugs for his own use.

Sometime after leaving Westboro, police said, Mr. McGuire met up with Mr. Savage, Ms. Marlborough and the alleged drug dealer, Mr. Povez, near Park Avenue and Main Street. The group drove to Florence Street.

According to court records, Mr. Povez was in the back seat with Ms. Marlborough and Mr. Savage was in the front. Mr. McGuire allegedly received crack cocaine from the dealer and then pulled out a fake handgun.

“He took out the fake handgun and said, ‘Get out of the car,’ ” Mr. Murphy said. A struggle started and Mr. McGuire dropped the fake gun. The three fought outside the car and Mr. Povez allegedly stabbed Mr. McGuire in the upper left leg. The stab wound hit Mr. McGuire’s femoral artery and he bled to death after getting back into the driver’s seat of the BMW. Police said Mr. McGuire died sometime between 12:30 and 1:30 a.m.

“They left him in that car. He died in the car,” Mr. Murphy said.

In Central District Court yesterday, Mr. Povez yelled out as court officers ushered him out of the courtroom, “The dude had a gun and I’m charged with murder.”

Around 2:30 a.m. Monday, Officer Joseph Essex saw Mr. Savage get into a car near Main and Wellington streets. The officer stopped the car and spoke to the female driver, then noticed fresh blood on Mr. Savage’s shirt, according to police. Mr. Savage told the officer he had cut his hands, although the officer saw no cuts. The other two suspects were not in the car.

Detective Lt. James J. Johnson commended Officer Essex for good police work. “His heads-up and quick recall of the events led us to our first concrete lead in the case.”

Later in the morning, Mr. Savage was seen entering what police called a known drug house at 776 Main St. and was arrested because the home was posted no trespassing. When questioned by detectives about the homicide, he was at first reluctant to talk, Lt. Johnson said. “Once he found out this person died as a result of the stab wound, he became more forthcoming with information.” Police would not say what Mr. Savage told them.

Detectives learned about the two other suspects and began looking for them. Ms. Marlborough, a mother of two who is known to police, was found on Main Street around 10 p.m. Monday and was picked up on warrants for other open cases, including larceny over $250 in connection with the theft of thousands of dollars from a bank.

Around 5 a.m. yesterday, Officer Michael Foley checked Madison Street, where vans line up to take people to New York City. In one of the vans he noticed a familiar face and went back to his cruiser to check Mr. Povez’s photograph. When he returned, the van was gone. Officer Foley quickly searched for the van and found it parked at a gas station at Kelley Square, where the vehicle had stopped so passengers could buy coffee at a Dunkin’ Donuts.

Mr. Povez, who has a lengthy criminal record of assault and other charges and is listed as a Level 3 sex offender, allegedly had three duffle bags with him and a pellet gun tucked into the waistband of his pants, Capt. McGinn said. Mr. Povez was brought back to the police station for questioning.

Detectives with search warrants checked the three duffle bags and found enough evidence to also charge him with crack cocaine possession with intent to distribute, Lt. Johnson said. That charge is being filed in court.

“Other evidence has been obtained through search warrants,” Lt. Johnson said. He declined to disclose what evidence was found.

In roughly 25 hours, police had all three suspects. All were held without bail on the murder charge yesterday in court. Ms. Marlborough is also accused of violating probation and had tested positive for cocaine, according to probation officials. Mr. Savage was also charged with trespassing. All three will return to court May 20.

Mr. McGuire’s girlfriend had no comment yesterday for a reporter who saw her leaving the police station. She said Mr. McGuire didn’t live with her in Westboro, although authorities say he did. Mr. McGuire’s family said he went back and forth from Westboro to Sudbury, where he has family.

Mr. McGuire’s aunt, Karen B. Reimann, said when contacted at the family’s home in Sudbury yesterday that she did not know what her nephew did in his own time.

“When he was here, he was never drugged out or anything,” said Ms. Reimann of Maynard. “I just know he’s got to be the biggest-hearted person when it comes to kids.”

Her nephew had demons he couldn’t shake, she said, stating that he has been in jail.

Criminal records show that Mr. McGuire was arrested on drug and theft charges in the past. He was also sentenced in Norfolk Superior Court in 1995 for armed carjacking. He received a six- to eight-year sentence, criminal records show.

“He’s done time,” Ms. Reimann said. “He was straight when he came out.”
