Trial Ordered For Man Accused Of Driving With Body In Car's Window

MURRIETA, Calif. -- A Perris man accused of driving his car home, and then to a fire station, with the body of a motorcyclist lodged in the rear window must stand trial on gross vehicular manslaughter and DUI charges, a judge ruled Tuesday.


Riverside County Superior Court Judge Judith Clark, who presided over the preliminary hearing for Tony Martinez, a 54-year-old liver cancer patient, determined that a trial was warranted based on the evidence presented.

He faces 15 years in prison if convicted of the charges, which include allegations of great bodily injury, leaving the scene of a crime and committing a serious felony, Deputy District Attorney Blaine Hopp said.

The defendant allegedly pulled out of a market driveway on Highway 74, near Ethanac Road, and directly into the path of an eastbound motorcycle, which struck Martinez's vehicle from behind, about 8 p.m. on Aug. 25. 2007.


It's unclear whether Nicholas Justin Campbell, 20, of Moreno Valley, was killed on impact -- he suffered massive blunt force trauma injuries -- but apparently Martinez was not aware the man was lodged in the rear window of his Saturn hatchback as he drove home.
