Brandeis Police: Two Students Arrested in Mods

Two students were arrested by Waltham police and Brandeis public safety officers in the early morning Sunday, March 30 following fighting that broke out during a party in the Foster Mods.

Witnesses estimated 11 officers, including seven from the Waltham Police Department, arrived to break up the unregistered party at about 2 a.m. after the Department of Public Safety received two calls reporting a fight. One of the callers suggested a gun may have been present, but no weapon was found.

Waltham police arrested 20-year-old Rashad Baldwin '11 for disorderly conduct. Detective Sgt. Tim King of the Waltham Police Department said Baldwin repeatedly ignored officers' request that he leave the scene at Mod 22, swore at the officers and incited the crowd. Baldwin denied each of these accusations and said no officer read him his Miranda rights.

"A bunch of lies were in the police report," Baldwin said of the Waltham Police Department's account of the incident.

A Brandeis officer arrested 21-year-old Walaa Sbait '08 for disorderly conduct soon after Baldwin's arrest, and both were taken to the Waltham Station that night and held in cells until about 5:30 a.m. Sbait declined to comment Monday night.

Sbait and Baldwin appeared at an arraignment March 31 and have pretrial hearings scheduled for May 8, the clerk's office in the Waltham District Court said. Baldwin said he is acquiring legal representation.

According to the Waltham police report, when officers attempted to break up the party, Baldwin repeatedly ignored an officer's command to leave and shouted: "I'm not fucking leaving. I'm waiting for my brother." Baldwin said he never uttered a vulgarity and the officer only asked him once to leave.

"I never told them I wasn't leaving," Baldwin said, adding that he only said he didn't live at the residence and that he was waiting for his brother, and one of his friends, to come outside. He said he then turned his back to the officer, began walking away and started to make a call on his cell phone to a friend to pick him up. It was then that a Waltham officer arrested him, he said.

"I guess I didn't move fast enough for him," Baldwin said with a note of sarcasm. "If you don't move right away when the cops tell you to leave, you get arrested."

Director of Public Safety Ed Callahan said some from the crowd were being uncooperative. "Police repeatedly asked individuals to leave, and they didn't comply," he said.

When officers arrived at the Mod, Callahan said the fight was still going on and one student was being assaulted. Witnesses said neither Sbait nor Baldwin initiated the fight, nor were they assaulted.

Mod 22 resident Gabriel Gaskin '08 said a group of about 10 non-Brandeis individuals had shown up at the party uninvited around 11:30 p.m., and at about 1:30 a.m., several of them physically attacked a couple of Brandeis students, initiating the fight. Baldwin and Gaskin said Baldwin helped break up the fight.

The non-Brandeis individuals ran out the back door of the Mod onto South Street just before officers arrived, Gaskin said. The Public Safety report said 15 individuals were seen running on South Street. Callahan said Public Safety is looking for these individuals.

Because they heard a weapon might be involved, University officers-who are unarmed-called Waltham for backup. Both groups of officers arrived on scene to find about 50 people yelling and running around, King said.

Baldwin said nowhere near 50 people were present, and the scene was not that chaotic.

King said Baldwin was making it difficult for officers to disperse the party guests, as he was standing in front of the door to the residence, blocking the way for others to leave.

The report states Baldwin was getting the crowd riled up, as they started chanting, "Fuck the police," and "Fuck you pigs," and "appeared to be following the lead of Baldwin."

Callahan described the scene as disorderly and out of control as well.

Baldwin denied these claims. "I'm not some type of ringleader. No one was following me," he said. "I didn't feel like the crowd was getting intense. They were just wondering and questioning why I was being arrested."

When Baldwin was cuffed outside the Mod, "he was calm. He wasn't upset; he wasn't riled up," Gaskin said.

Once Sbait saw that Baldwin was being arrested, he approached a Brandeis officer and asked in a calm voice why Baldwin was getting arrested, Gaskin said.

The Brandeis officer, Gaskin said, pushed Sbait against the Mod, even though he clearly said, "Officer, I'm not resisting arrest."

"It's crazy," Baldwin said. "It really surprises me how they handled the situation with no professionalism at all." Baldwin, who is black, also suspects that his race played a role in the officer's decision to arrest him.

Baldwin said he and Sbait were never given the opportunity to write up their side of the story at the station.

They were released on personal recognizance, King said.

Sbait, a Palestinian student from Haifa, was arrested by Brandeis officers outside the Mods in October 2006 after a heated confrontation with an officer.

Brandeis students arrested at a house party on South Street last semester complained that Cory Amarante, one of the Waltham officers who arrived at Mod 22, had used excessive force.

Mod 22 suitemates may face University judicial action, Gaskin said.

yeah, this seems about right. I think it is hilarious that the arrested students still don't realize the full extent of getting arrested. They actually thought they would be given a chance to "Write a detailed account" of their side of the story??? Gimme a break, this is the Police Department, not the principal's office at prep school.

Nice job Brandeis and Waltham PD under tough circumstances........!

These were the smart intelligent kids. Maybe you should run like these kids when the cops come and you would have avoided all of this.

Ain't is just like those Gestapo cops to come to a wild out of control party and go nuts. I'm surprised that several students didn't claim to have been hit by nightsticks and peppersprayed for no reason.

TWO arrests? TWO? Oh wow, those cops were OUT OF CONTROL!

Can you picture the scene and really expect some kid will calmly walk up and in a soft pleasant voice ask, "Pardon me Officer, may I trouble you with a question? Are you too busy? I was just wondering why my friend was being arrested. I'm sorry to trouble you, I'll leave now."

Anyone else notice that the words Brandeis and Police were never put together? It was always 'public safety' and simply 'officer'. Interesting.

Good job Waltham PD and Brandeis PD. We on this board give you all the credit in the world for your restraint under the circumstances.

Is it me or are these kids getting worse, or am I just getting old, perhaps both..lol?? The self entitlement is ridiculous...You can party without being an ahole??..Also, I agree...I see alot of these colleges calling their officers "Public Safety Officers." It reminds of a skit George Carlin used to do on euphemistic language..Keep adding syllabels to titles or conditions and people and it will lessen it's true severity or credibility..For example..the condition vet suffer from starting in WW1 went from..shell shock..to battle fatigue, to post tramautic stress disorder..He has a whole list like that and its funny as well as an eye opener..We dont have POLICE...We have Public Safety Officers!! lol..I guess people are that stupid..I digress...Nice job Brandeis and Waltham PD's

EDITORIAL: Arrest without a warrant



It's been more than two weeks since University and Waltham officers arrested Rashad Baldwin '11 and Walaa Sbeit '08 on charges of disorderly conduct, and this page is struggling to understand the officers' handling of the situation. The reports don't add up, and that's troubling. Particularly when arrests are involved, police need to be able to account, in detail, for their actions.

Reports from campus and Waltham police sources cited variously: a mass of some 50 students yelling and running amok outside; 15 people fleeing down South Street; and a fight in progress when officers arrived on-scene. Yet the Waltham Police insists that Mr. Baldwin was subverting officers' attempts to disperse the mob by standing in an open doorway, preventing students from leaving.

The police are telling us that there was a half-a-hundred-strong swarm of rabblers outside, complete with students fleeing in all directions and an assault happening right under their noses, but that Mr. Baldwin blocked traffic by standing in a doorway. Presumably, the police would be a lot more concerned with the bristling masses outside than the lagging partiers inside. These contradictions are disturbing

Mr. Baldwin also reportedly snubbed an officer's repeated commands to leave the premises. But Mr. Callahan tells us that Mr. Baldwin wasn't the only individual that the police "repeatedly" ordered off the grounds, and he certainly wasn't the only one who was noncompliant.

Finally, the Waltham arrest report describes how Mr. Baldwin goaded on the already-stirred crowd by starting chants of "Fuck the police" and "Fuck you pigs." But not one witness this paper spoke to could back that up.

This page is wary. We aren't saying that Waltham officers were wrong to cuff Mr. Baldwin, but we aren't saying they were right either. The fact is, the officials' stories don't coalesce the way they should, and this page can't iron out exactly why Mr. Baldwin in particular should have been arrested.

On the other hand, it's dangerously easy to fall into the trap of instantly blaming the police. Especially when race and nationality are involved-Mr. Baldwin is black, and Mr. Sbeit is Middle Eastern-it's almost a knee-jerk reaction to peg these cases as unfairly subjective or unashamedly bigoted. But however teasingly alluring it may be to fit Mr. Baldwin's case into one of these molds, this page encourages its readers not to fly blindly to their peers' defense without first considering the officers' position.

After all, just because other students ignored orders to leave doesn't mean the police were wrong to single out Mr. Baldwin. By the same token, just because student witnesses denied reports of rabble-rousing doesn't mean Mr. Baldwin wasn't trying to raise hell.

That being said, though, this case stinks. It's hard, for example, to brush off cries of racial insensitivity when the booking report dutifully reports Mr. Sbeit's tattoo of a "Palastinian refuge boy," and it's even harder to reconcile this arrest with a 2006 incident in which Mr. Sbeit was arrested under similarly hazy circumstances involving a campus officer allegedly threatening Mr. Sbeit with mace.

The bottom line? Brandeis and Waltham police officers have a history of sticky practice, and they need to be more conscientious, transparent, dutiful and even courteous when they're out there doing their jobs. If they want the student body to take them seriously as the face of law, they need to act the part.

This page says be fair when pointing the finger at the obvious police overreaction and probably racist actions. Don't be too quick to judge the police who for all intents and purposes are wrong and should be fired, but don't be hasty in calling for that just course of action. Please see their biased side of it and don't condemn them JUST because they're the police. That would be wrong and we don't want that.



Puh-LEEZE! The writer of this tripe should just be honest and say, "Even if these two were found over a dead body holding guns and yelling, 'We killed this bastard', they are probably being framed by the cops."

So, according to the above editorial, Mr. Sbeit is a victim of constant police harassment, not just a jerk who eggs on the police and then cries when there are repercussions. It's just sickening. This kid really does have a good future in journalism should he wish to pursue one. He's got the bias down cold.
