Well, I won't lose sleep thinking about this weapon in the hands of your average criminal. It would be considered a SBR (short barreled rifle) in semi-automatic, requiring a $200 tax stamp and BATF approval to acquire. With an auto sear, it would be considered a machine-gun, and since its manufactured after '86, could only be acquired by police, military and certain dealers for sale only to police or military.
I am more worried about the homeboy with the rusty, stolen .380 tucked in the front of his sagging pants, then the Hollywood-fueled image of Compton "Gangstas" rolling with MP-5's and Styer AUGs.
The folding SMG is an intriguing concept, although I find little practical value in it. Its actually very similar to the Ares folding submachine gun, produced only in prototype versions and seen in the movie Robocop II.
