Here's a question that seems to be a very "gray" area. You are lawfully conducting a search of a passenger compartment of a M/V for 94C with pc. At what point can you conduct a search of the closed trunk of the m/v. I have heard about 5 different thoughts. Can anyone help a rookie?
(THE PC FOR THE SEARCH IS ONLY FOR 94C)
Here are some of the thoughts:
1. If you have pc to search the car for 94c, this extends into the trunk.
2. You must find a large amount within the passenger compartment first.
3. You need consent.
4. Only if there is means of acces from passenger compartment.
5. And the most helpfull one..... "Who cares"
Any thoughts, case law, or anyone have some solid knowledge?
