Ga. officers shoot each other

BUFORD, Ga. — Two off-duty officers from different police departments wounded each other in a gun fight in the middle of a road in an Atlanta suburb, authorities said.
Both officers suffered non-life-threatening wounds, police said. Their conditions were not immediately known on Saturday.

Officer Jay Daily, a five-year veteran of the Duluth Police Department, exchanged multiple gunshots with Fulton County officer Paul Phillips on Friday afternoon, police said.

Daily was in custody Saturday, charged with aggravated assault, Cpl. Illana Spellman of the Gwinnett County police said.

''It's been confirmed that the Duluth police officer was the aggressor in this case,'' Spellman said.

Phillips, 37, required surgery at Gwinnett Medical Center. A hospital spokesman said Saturday he could not release information about the two officers. He referred questions to Spellman, who did not immediately have an update on their injuries.

''It's been baffling to us why this situation even occurred,'' said Duluth Police Chief Randy Belcher. ''It's an embarrassment to this agency.''

Phillips, who was wearing his uniform and in a marked police car, was driving to his home in Gwinnett County, police said. He was flagged down by someone who had seen Daily involved in a physical altercation with a woman in a sport-utility vehicle.

Daily, who lives in the area, was off duty and in civilian clothing but was wearing a bulletproof vest, police said.

Police did not know what relationship Daily had with the woman or what started the confrontation. The woman, who was not identified, later was hospitalized for minor injuries she suffered before the shooting started, police said.

Belcher described Daily as ''an outstanding officer'' and said he was suspended while the investigation is under way.

Ga. police puzzled by officers' gunfight

GWINNET COUNTY, Ga. — Two police officers wounded in a shootout with each other continued to recover from non-life-threatening injuries in a Gwinnett County hospital Saturday while authorities tried to sort out the odd circumstances surrounding Friday's gunfight.
"I've seen people snap. I've seen incidents where people felt like their lives are passing them by," Don Woodruff, a spokesman for the Duluth Police Department, said Saturday. "But to see a police officer do this is just unreal."

At about 1 p.m. Friday, authorities say, Fulton County police Officer Paul Phillips, 37, was on his way home in suburban Sugar Hill. He was in uniform and driving a marked car. He stopped to help a woman who was leaning out of her parked car and yelling for help, according to Gwinnett police.

That's when police say a man in civilian clothes, later identified as Duluth police Officer Jay Daily, 42, jumped out from behind the woman's car and began shooting at Phillips, hitting him once. Phillips returned fire, police said.

The unidentified woman who cried for help was arguing with Daily before Phillips pulled over, according to Kathy Santry, a witness. Santry said the driver's side window of the woman's car was shattered, and the woman had blood on her hands.

An arrest warrant was issued for Daily, said Cpl. Illana Spellman, a spokeswoman for the Gwinnett County Police Department, which is investigating the shooting. Daily is charged with aggravated assault on a law enforcement officer.

"We don't know the motivation for what [Daily] did," Spellman said Saturday.

Spellman said she did not know the name or the extent of the injuries of the woman seen arguing with Daily.

Saturday, Gwinnett County sheriff's deputies were guarding Daily, a member of the Duluth force for five years, at Gwinnett Medical Center. Daily is on paid suspension for now, according to Duluth Police Chief Randy Belcher.

"We're in just as much in shock as anyone," Woodruff said. "He was such a quiet, laid-back officer."

Officer Scott McBride with the Fulton Police Department said it was not known when Phillips will be discharged from the hospital.

Bizarre Details Released in Georgia Officer Vs. Officer Shooting

GWINNETT COUNTY, Ga. --
The Duluth police officer accused of shooting another police officer went before a judge for the first time Tuesday.
With his left hand still bandaged from a gunshot wound, 42-year-old Jay Dailey tried to cover his face from courtroom cameras. Dailey, a Duluth police officer, made his first court appearance since he was arrested for assaulting a female driver and opening fire on a Fulton County police officer February 1.
A detective took the stand Tuesday with details of what Dailey said to investigators.
"He told them that he remembered walking down Level Creek Road, he remembered wrecking his car, and he started making a motion as if he was pulling a trigger, and he said that his finger was tired,” said Det. Shelly Millsap with the Gwinnett County Police Department.
Tuesday, Millsap took the stand and said when the female driver, Laresa Graham, was driving down Level Creek Road in Sugar Hill, Dailey flagged her down and told her he was a police officer, was injured and needed help so she began to call 911.
"He reached in, grabbed her phone, he was cursing at her, threatened her, she said that was when he started saying, ‘I'm going to kill you, you're ruining my life now,’ said Millsap.
Police said Dailey eventually pepper-sprayed Graham in the face before pointing his gun at two passer-bys who stopped to help, then shooting at Fulton County police officer Cpl. Paul Philips, who was on his way home when he pulled up to the scene. Philips was shot in the left arm and had to undergo surgery.
Millsap also talked about what Philips said happened. "He said almost immediately the guy (Dailey) drew his weapon. He said he stuck up his left hand to say hold on, and as he put up his hand, he heard the first shot, and he said he knew he had been hit in his left arm. He drew his weapon and returned fire,” said Millsap.
Dailey’s attorney had no comment for Channel 2 Tuesday. His family was also in the courtroom and visibly upset. They also had no comment.
Dailey remains in the Gwinnett County Jail without bond.
