FRAMINGHAM - A Framingham man punched and kicked an officer Thursday when the man was told he would be placed in protective custody because he was drunk, police said.
Peter M. Gentilotti, 40, was arrested at the Winthrop Hotel, 73 Hollis St., a shelter run by the South Middlesex Opportunity Council.
Gentilotti went to the shelter at 6 p.m. but was told by workers he would not be allowed to stay, said Deputy Police Chief Craig Davis.
"The requirement is you can stay there, but you have to be sober, and he showed up intoxicated," the deputy said. "They asked him to leave, and he refused. He went into a room and started throwing furniture around and yelling."
The staff called police and officers were greeted by a still out-of-control Gentilotti.
The officers told him to calm down, or he would be arrested.
"He said he would be willing to leave, but at this point, the officers told him he could not leave because he was intoxicated and would be taken into protective custody," Davis said.
Gentilotti immediately became upset and punched Officer Val Krishtal in the face and kicked him in the knee, Davis said. Both were described as "glancing" blows and Krishtal was not injured, the deputy said.
The officers began to struggle with Gentilotti and finally sprayed him with pepper spray to get him under control, Davis said.
Gentilotti, who gave his address as the shelter, was charged with assault and battery on a police officer, assault and battery with a dangerous weapon - his foot - resisting arrest and disturbing the peace.
"They were just going to place him into protective custody, but he started fighting, so that deal was off the table," Davis said.
During the struggle, Gentilotti suffered a cut on his face, but he refused treatment once he was brought to the MetroWest Medical Center's Framingham campus.
Gentilotti was ordered held on $2,000 bail at his Framingham District Court arraignment yesterday. However, his bail on an open operating under the influence of liquor third offense case was revoked, meaning even if Gentilotti posts bail on the new case, he will continue to be held at the Middlesex Jail. He is due back in court later this month.
