Tanning Booth Peeper Must Apologize In Church

A Concord, NH man accused of using a mirror to spy on a woman at a Loudon Road tanning booth pleaded guilty yesterday. He was ordered to pay $500 and to apologize before his church on a Sunday morning.
Joseph Johnson, who turned 54 yesterday, was arrested July 16 after a 26-year-old Concord woman said she saw him holding a mirror over the divider between the booth he was in and her own. She was mostly undressed, according to a police report.
Johnson, of Grove Street, was charged with violation of privacy, a misdemeanor. During sentencing yesterday, a $1,000 fine was imposed, with half of it suspended. Johnson can have no contact with the woman and is banned from all tanning facilities in New Hampshire.
Assistant City Prosecutor Tracy Connolly said the victim had requested that an apology be a condition of Johnson's sentence. His lawyer proposed that Johnson do it before his church in Pembroke, she said.
"I take the victim's input," Connolly said. "She was okay with that."
Both Johnson and his attorney, Earle Wingate, declined to comment yesterday.
Connolly said lawyers can be creative in negotiating the conditions of a sentence. She said a public apology is not a common stipulation, although this was the second case that she's handled in two weeks in which the defendant was ordered to apologize before a church.
The spying incident occurred at Turbo Tan on Loudon Road. The owner previously told the Monitor that the booth Johnson used was the only one where the walls did not extend to the ceiling. The owner has since closed that space.
