BARNSTABLE -- Convicted Cape Cod bank robber Timothy Elliott can keep $1 million in Lottery winnings and won't go to jail, even though a judge said he violated his probation by buying a scratch ticket.
In an agreement with probation officers was announced this morning at Barnstable Superior Court, he will have to pay $65 a month to have his compliance monitored. Elliott, who's 55, declined comment afterward, according to the Associated Press. He's already collected the first of 20 annual payments of $50,000.
Elliott made national news in December, when he was charged with violating his probation by purchasing a $10 scratch ticket for the Lottery's "$800 Million Spectacular" at a Hyannis Stop & Shop in late November. He was indigent at the time, and on probation for pleading guilty to an unarmed bank robbery in 2006. Among other conditions, he was prohibited from gambling, but his attorney said today there was never much question that he'd be allowed to keep his Lottery prize.
But Elliott's legal troubles aren't over yet. He must still face a contempt of court hearing for failing to pay almost 30 years' worth of child support. In a 1979 Nantucket divorce agreement he was ordered to pay his ex-wife $75 a week. He now owes her $37,900.
This is crap! He knowingly and willingly violated the terms of his probation. Naturally, the defense attorney considers it a "minor" violation. News flash - it's still a violation!! I'm sure he'll find some reason why his client shouldn't fork over some of the illegally-obtained winnings to the ex-wife and kid(s) he failed to provide for.

It was on he news he has to pay the wife and pay probation a monthly fee
for administration as long as he is on probation.

If it was part of his probation not to gamble or play the lottery it is a violation. If they have no intention on enforcing such terms, then don't make them. All of the money should be donated to some victim/witness fund or a worthwhile cause like the Dr. Magoo fund for grumpy police officers.
