Randy Moss Denies Domestic Violence Allegation

FOXBOROUGH, Mass. (WBZ) ― Just days before the New England Patriots play the San Diego Chargers in the AFC Championship, Randy Moss is dealing with a serious allegation.

A woman has filed a temporary restraining order against the Patriots' talented and controversial wide receiver in Florida for "protection against dating violence."

A Florida radio station obtained a copy of the affidavit and is reporting that Broward County authorities have granted the woman the order.

Moss is accused of committing a "battery upon a woman causing serious injury" and he allegedly "refused to allow her to seek medical attention."

No criminal charges have been filed against Moss.

He told reporters in the locker room at Gillette Stadium Wednesday that he did not hurt the woman and that she's trying to extort money from him.

"I want to make something clear, in my whole entire life of living, 30 years, I've never put my hand on one woman, physically or in an angry manner," Moss said.

"So this battery that they're talking about, I guess from a legal standpoint there has to be something said."

According to the affidavit, "Moss cannot come within 500 hundred feet of the victim and cannot use or possess firearms."

Moss said he's known the woman for 11 years and she wanted a six-figure settlement.

"All I know is that it was a friend of mine, a young lady. It was an accident where she hurt herself… to where they called me, called my attorneys trying to get X amount of dollars out of me and if we don't get X amount of dollars, we're going to go to the press before the game, before this game."

The Patriots play the Chargers Sunday at Gillette Stadium for the AFC Championship.

"I am aware of what's going on and I don't really want people to rush quick to judgment and not knowing the facts. My teammates don't have anything to do with this. They don't know anything. I think this was just brought to their attention."

Moss, who set an NFL record with 23 touchdown catches this season, said he spoke with coach Bill Belichick about the matter. Moss spoke to about 30 reporters in the locker room after Belichick's regular news conference at which the coach wasn't asked about it.

This is not the first time Moss has been in trouble with the law.

In high school, he took part in a racially-charged fight that left one person in the hospital. He entered a plea of guilty to battery charges and received probation along with a suspended sentence of 30 days in jail.

In 1996, while serving a 30-day jail sentence, Moss tested positive for smoking marijuana; thus violating his probation. He served an additional 60 days in jail.

In 2002, Moss was arrested after allegedly bumping a Minneapolis traffic cop when she stood in front his car as he attempted to make an illegal turn. A search of his car found a small amount of marijuana. He later pleaded guilty to a misdemeanor traffic violation, was fined $1,200 and performed 40 hours of community service.

He's also had several disciplinary incidents related to his conduct on the football field.

However, since he was traded from the Oakland Raiders to the New England Patriots in the off-season, Moss has been a model citizen.

According to the affidavit, a hearing on the domestic violence charge is scheduled for January 28, just six days before the Super Bowl.

At that hearing, the court will determine whether to file a permanent judgment of injunction for protection against dating violence.

FOXBOROUGH, Mass. - Randy Moss said Wednesday that allegations he committed battery against a woman are false and that she made the claim to get money from him.

"I want to make something clear," the Patriots wide receiver said while surrounded by reporters and cameras at his locker. "In my whole entire life of living 30 years, I've never put my hand on one woman, physically or in an angry manner."

Florida radio station WDBO reported that a woman filed for an order of protection against Moss, alleging he committed battery against her. The report said a temporary injunction was issued, barring Moss from coming within 500 feet of the woman and from using or possessing firearms.

Moss gave no details of the alleged incident, saying he was restricted by the legal case.

He said the woman was a friend of 11 years and that she asked for "six figures" for what Moss said was an accident in which she was hurt.

"They're false allegations, something I've been battling for like the last couple of days of threats going public if I didn't pay X amount of dollars," Moss said. "So before people rush quick to judgment I think you need to find out the facts about, really, what's going on.

"This young lady by no means is hurt. I didn't hurt her."

New England plays the San Diego Chargers in the AFC championship game in Foxborough on Sunday.

Moss has avoided off-field problems this season and has been hailed by other Patriots players as an excellent teammate and leader. In his previous nine seasons - seven with Minnesota and two with Oakland - he was involved several incidents.

With Minnesota, he was criticized by quarterback Daunte Culpepper and others for leaving the field with 2 seconds left in a regular-season loss to Washington. He bumped a traffic control officer with his car in 2002, verbally abused corporate sponsors on a team bus in 2001 and squirted an official with a water bottle in 1999.

He strongly denied the latest allegations, breaking his usual midweek silence.

"It's very unfair to athletes if a person makes a false claim. You know, there's nothing that we can do," Moss said. "The only thing that we can do is either pay up or sit back and listen to what's being said or what's being written.

"For someone to make a false claim about me, I'm kind of furious," he said. "It kind of hurts me deep inside for someone to do something like that because, you know, I've always said time and time again, I'm going to stand up for what's right. If I'm right, I'm right. If I'm wrong, I'm wrong."

FOXBOROUGH, Mass. (WBZ) ― The woman who claims Randy Moss attacked her responded Thursday to his claim that she's trying to extort money from him.

Rachelle Washington of Ft. Lauderdale, Florida filed a temporary order of protection against the Patriots wide receiver Monday in Broward County Court.

Moss said the allegations are false and Washington made the claim to get money from him.

Washington's attorney released this statement to Florida radio station WDBO Thursday.

"For the past 11 years, Ms. Washington has cared deeply for Mr. Moss and has been there for him throughout all of his trials and tribulations. However, she refuses to be further disrespected by him. It has never been her intention to hurt Mr. Moss in any way.

"However, she has suffered mental and physical harm as a result of his actions. She simply wants him to take responsibility for what he has done. As a battery victim, she has shown great strength throughout this entire ordeal.

"Ms. Washington has been unfairly characterized as someone simply seeking financial gain. In fact, it was Mr. Moss' representatives who first contacted our office to offer a "six figure" settlement with hopes of not having this incident become public record.

"We have heard Mr. Moss' statement regarding the incident. He has acknowledged that he was at Ms. Washington's Florida residence and that he was "guilty" of an "accident" which occurred. However, Mr. Moss fails to mention how his reckless and degrading conduct rendered Ms. Washington unable to drive her vehicle to seek medical attention.

"As the evidence will show, there is serious doubt that Mr. Moss is capable of recalling with clarity the exact details of what transpired that evening. As Mr. Moss has previously stated, "Do your homework and check his resume."

"We look forward to presenting all of the evidence at the court hearing on January 28, 2008."

No criminal charges have been filed against Moss.

He told reporters Wednesday Washington wanted a six-figure settlement from him.

According to an affidavit obtained by WBZ, Washington claims she's been in an "intimate relationship" with Moss since 1997.

Tim DiPiero, agent for Patriots receiver Randy Moss, emailed the following tonight regarding the situation regarding his client:
My communications with Mr. McGill began last Wednesday. He told me that Randy had intentionally hurt his client’s hand and wouldn’t take her to the hospital and that if Randy didn’t pay up, he would go public and file suit in Florida for battery. He gave me until 3 pm Friday to let him know. He demanded that I not come up with “something like $50,000 or $75,000,” but something with “six figures.” He had told me that the x-rays on her hand or finger were negative. I explained that it was my understanding that what occurred was the result of a horseplay-type accident and Randy was sorry it had occurred and he would pay for her medical bills and pain and suffering and that I would prefer to turn this over to his homeowners’ insurance coverage as we normally do with accidents. He said he was not interested in insurance or what her injuries were. He said he was evaluating the claim based on what Randy stood to lose. He threatened that Randy would suffer large amounts of money in future salaries and endorsements and what he claimed would be game suspensions.
He also threatened that his client had lots of “dirt” on him. Making such threats is clearly unethical, and in my opinion, criminal. When I tried to ascertain the extent of her injuries, he said that he didn’t know and that it didn’t matter as I just needed to make an offer big enough that she would take it. I sought the assistance of a skilled attorney and friend, Joe Friedberg of Minneapolis, who contacted a friend of his, Richard Sharpstein in Miami, to assist me. Each of them tried to talk to McGill and they both experienced the same attempts to shake down Randy. In fact, he tried to intimidate me by telling me that I would be blamed if the suit got filed. He said in a threatening tone that “it behooved me” to make a big offer and he told me, “don’t blow it.” On Friday afternoon, I contacted the FBI and the US Attorneys’ Offices here in Charleston about his threats. McGill claimed to be driving to the courthouse to file the complaint. I asked if by six figures, he meant $100,000 and he told me to quit “nickel and diming” him. The filing time passed on Friday and he was upset that he had not filed before the Patriot game on Saturday. He kept pushing me to make a big offer. We asked him for a figure and after refusing for awhile, he gave us one, “$500,000, take it or leave it.”
People who know me in West Virginia know that I have had a long relationship with Randy and that I care a great deal about him. His success this year on and off the field has been something those of us who are close to him have enjoyed immensely. The private, glowing reports I have received from folks in the Patriots organization about his daily work ethic and rapport with everyone there made us ecstatic for him, given the difficulties he’s had. The Patriot family has come to know him as we do. With this big game coming up and with the media frenzy that I figured would follow, as it has, I admit that I thought about advising Randy to just pay the $500,000. I knew that Randy, given all the positives this year, would not want this situation to hurt the Patriots, especially now, and to be a distraction for his teammates and would pay much more than he should for the sake of the team. Because I’m too close to the situation, I had to listen to the advice of Mr. Friedberg and Mr. Sharpstein who advised me, correctly, that to pay such an outrageous amount was not the right thing to do. We tried to meet with Mr. McGill on Monday, but he refused to do so. I still didn’t want Randy to face all this craziness, and naturally we wanted to settle this thing and were willing to pay an exorbitant amount to do so, so when he asked for an offer on Monday, we said, something to the effect, “you said six figures, how about $100,000?” He said it had to be $500,000 or nothing. We told him to forget it. He had his client file the domestic petition the next day.

I don’t want to add to the media frenzy, but I must respond to Mr. McGill’s recent inaccurate statement. I want the U. S. Attorneys Offices in Miami and Charleston, the Prosecuting Attorney of Dade County and the Florida State Bar, whoever has jurisdiction over Mr. McGill’s conduct, to know that I am ready to meet with any and all of them and to testify regarding the blatant threats and attempts to extort money from my client.

my original thought was San Diego had something to do with it. funny the incident supposedly happened before last weekends games then all of a sudden now that the teams are set for this week these allegations surface... got to wonder if San Diego is trying to break the pats concentration

Now I don't know Randy's situation....and am not saying that he is innocent. But it brings a thought to mind:
It's unfortunate that the domestic violence system in this state and others is sooo screwed up. Too many women take advantage of the system now-a-days. Yes, take advantage!! Piss off a woman.....and she marches down to the local police station, lies her a*s off, and gets a temporary restraining order. What is so unfortunate about this...is that it doesn't give any credibility to the women that really need them....ya know? The women who are really being abused.
Any woman can walk into a police station and sob some tears, make up a story, play the poor, pathetic victim, and get a paper.
It's pretty f'd up!!! These women should be ashamed of themselves, for exploiting the system the way that they do! ASHAMED!!!!!!

Money woes haunt moss pal

She hasn’t been able to pay her rent




The friend: Rachelle Washington, 35, claims Patriots receiver Randy Moss battered her in her Florida apartment Jan. 6. Moss claims she asked him for $500,000 not to pursue action against him.

FORT LAUDERDALE, Fla. - The mysterious Florida woman Patriots [team stats] superstar receiver Randy Moss alleges threatened to go public with what he claims are bogus abuse charges unless he gave her $500,000 has a history of financial desperation, the Herald has learned.
Three separate landlords have attempted to kick Rachelle Washington, 35, to the curb over non-payment of rent - as recently as last month, according to sources and Broward County court records obtained by the Herald.
The woman from whom Washington rents her current condominium in Fort Lauderdale, where she claims Moss, 30, injured her physically and mentally with “reckless and degrading conduct” on Jan. 6, last month served her a three-day notice to pay up or get out, sources told the Herald, but Washington came up with the money in time to remain a tenant.
In December 2002, an exasperated Giovanna Pipia, owner of the Town View Apartments in Hollywood, initiated formal tenant eviction proceedings against Washington, whom she claimed was in arrears for $990 on her $190-per-week rent and utilities.
“I have been as understanding as humanly possible, but I have my own commitments and responsibilities regarding running my apartment complex,” Pipia wrote Broward County Judge Sharon L. Zeller in a Sept. 11, 2002, letter.
“I cannot pay bills and mortgages on just words and promises,” Pipia wrote. “I am only asking that she pays what is due in order to remain at Town View Apartments.”
At the time, Washington had applied for and received financial aid from the county to help her with a portion of her rent, according to information in court records.
Hoping to stay her eviction, Washington wrote the court saying she had begun work at a boutique and had asked her sister to move in to help defray expenses.
In June 2005 Felicia Albu, manager of the Monroe Apartments in Hollywood, served Washington a tenant eviction notice, complaining in court records that Washington was delinquent for a little more than $700 back rent.
Both cases were ultimately dismissed for lack of prosecution.
Attempts to reach Washington at her Fort Lauderdale home have been unsuccessful. Her lawyer has not responded to requests for comment.
Moss, meanwhile, is expected to request a continuance of his Jan. 28 court hearing in Fort Lauderdale to answer the temporary restraining order Washington obtained against him this week accusing him of dating violence.
His attorney, Richard Sharpstein, said Moss has not yet been served the restraining order, but “I as his attorney, will appear and agree to continue the restraining order until he can appear.”
Despite Washington’s claim that Moss owns firearms, Sharpstein said Moss has not turned over any guns. “Technically, until I appear, he is not subject to the court’s jurisdiction, but that’s just a technicality. He is 2,500 miles from her.”

The restraining order laws were enacted as a tool designed to protect those in the worst situations, those who could not protect themselves from harm, those who had no other options for themselves, (and often their children). In most cases, physical abuse had already been perpetrated against those seeking orders for protection. Sadly, the order has now evolved into a tool used for manipulation and revenge, by many who have means and many other ways out of an undesirable situation. In my opinion, it has now taken power away from women, when it is allowed to be used as a method of revenge. You can argue with your spouse or sig other for years, but that one time they want to trump you, that yelling is turned into a dreadful fear for their life. That one time they want to avenge a wrong or prove a point, you are stripped of your home, your personal effects, your children and your lifestyle. That is NOT what the law is for.

In my opinion, if a temporary order is granted, there needs to be a crime attached to it. Whether harassing calls, threats, or physical abuse - to have one thrown from their home for a weekend, you need more than just saying a few key words over the phone to a judge who is afraid to be on the cover of the Herald for not granting the order. Otherwise, you go to a courthouse, get sworn in and let the judge see your words, your demeanor and get the entire story and picture.

If in court, a judge finds 'no cause' to extend order, after an initial temporary one was granted by an on-call, then the 'plaintiff' should be charged with filing a false police report. She/he exaggerated, or downright lied in order to cause another to have restrictions placed on them for a time. If the 'defendant' shows up to court, offers her/his side and the judge finds them to be truthful and therefore vindicated - then the 'plaintiff' needs to incur some penalty. Perhaps reimbursement for work the day the def had to take off, pay for their hotel fees over the weekend, replacement personal effects purchased, the rental vehicle costs because their vehicle was at the home and they couldn't get it, etc. There should also be a way to track who is seeking emergency orders and where, so a 'shopper' can be identified. It is very common that once someone is successful in getting an order, they then turn to that means again and again in different relationships. They should take a look at themselves and ask: " gee, why can't I end a relationship without involving the police and courts??? "

Someone high up needs to step up and stop this pathetic trend - acknowledge that it is not working the way it was designed to!

Moss Won't Appear In Court Before Super Bowl

Football Player To Travel To Arizona


BOSTON -- Patriots wide receiver Randy Moss may not be distracted by a court hearing just before the Super Bowl.

The football star will not appear at his scheduled court appearance this coming Monday.

The Web site www.ESPN.com reported that Moss' lawyer will request a delay in a scheduled hearing to see if a permanent restraining order should be issued against Moss.
The appearance was scheduled after Rachelle Washington, a longtime friend of the receiver, accused Moss of battering her earlier this month.

Moss has denied the allegations and has not been criminally charged.

Moss will travel with the Pats to Arizona when they travel this weekend.

MIAMI (AP) ― A woman who obtained a restraining order earlier this year in a domestic violence case against New England Patriots star Randy Moss wants the case dismissed, court records show.

Rachelle Washington, 35, filed papers March 3 with the Broward County Circuit Court clerk's office requesting that the order be dissolved and the case closed. The restraining order had required the All-Pro wide receiver to stay at least 500 feet from Washington.

Moss, 31, denied he harmed Washington as she claimed at her Florida home on Jan. 6, or that he prevented her from seeking medical attention. Moss did acknowledge there was an "accident" involving Washington, but would not be more specific.

Moss attorney Richard Sharpstein said Tuesday his client was "extremely pleased" by the outcome. Moss plans to submit a claim to his insurance company for medical bills for services such as X-rays that Washington had for a hand injury, Sharpstein added.

"There has finally been acknowledgment that the injuries were not intentionally inflicted," Sharpstein said.

An attorney for Washington did not immediately respond to a telephone message seeking comment.

The restraining order was issued Jan. 14 after Washington accused Moss of "battery causing serious injury" in a civil domestic violence case. It came just as the Patriots were making their playoff run to the Super Bowl and angling for an undefeated season, which ended in a loss to the New York Giants.

Days before the AFC championship game, Moss said the claims were "false allegations" and that Washington had demanded a payment of "six figures" before taking legal action. He acknowledged knowing the woman for about 11 years.

"In my whole entire life of living 30 years, I've never put a hand on one woman, physically or in an angry manner," Moss told reporters in mid-January.

Moss has had other off-the-field problems in his 10 years in the NFL, including a 2002 incident in which he bumped a traffic control officer with his car and another in 2001 when he verbally abused corporate sponsors on a team bus. But since his acquisition by the Patriots last April, he has been viewed as a team leader.

He had another stellar year on the field in 2007, catching 98 passes for 1,493 yards and an NFL-record 23 touchdowns. For his career, Moss has 774 receptions for 12,193 yards and 124 touchdowns.
