Unmarked hicap wtf.

I plan on getting some preban Hi-Cap AR-15 and AK mags at the next gun show or when a local dealer who has them. However, I have been realising that many if not most preban vs postban mags will have distinguishable features. So the question is, If a dealer says "Here is a 30rd preban magazine" thats unmarked, How do I know? And heres the question that I suppose matters more. Does it even really matter? I read on northeastshooters that there hasnt been one case regarding hicap go to court yet. Anyways, If you wanted to be completely legal, but also wanted hicap mags, what would you do?

I guess if it's unmarked then you really don't know. However there could be unmarked mags from a manufacturer that wasn't around before the Federal AWB ... C-Products is one for example. Of course true "post-ban" mags will be marked for LE or Military use only.

If I were you i would only buys mags from a dealer in Mass not at a gun show.

Makers stoped marking the mags when the Federal ban expired. So, to that end, if you purchase a high cap mag and it isn't maked, me personally, I would assume that it was pre ban.....wink wink nod nod

It is the burden of the state to PROVE that the magazine in question was manufactered after the "ban" date, and prove that it was not in the state after the ban. Assuming the magazine has no manufacture date, it would be impossible to prove when it was made. Furthermore, because magazines are not serially numbered or controlled, it would be impossible to find out when it entered or didn't enter the state. Most prosecutors couldn't tell the difference between a AR-15 mag and an AK mag, so therefore they wouldn't touch a magazine case with a ten-foot pole. Nor would any but most morbidly anti-gun (and not very busy) police officer bother to try to charge someone in a magazine case.

Assuming you have a valid class A LTC, and you're not doing anything illegal with a firearm, I don't think any police officer or prosecutor would care where or when you acquired your magazines from.

Of course, this is just my personal opinion, and shouldn't be taken as legitimate legal advice or the position of any department I may or may not be a member of.
