Norwell Fire chief under fire; Operating to endanger charges recommended

NORWELL - Fire Chief T. Andrew Reardon will be charged with driving to endanger after striking a pedestrian last month.

Police Chief Timothy Ross said the charge was recommended by District Attorney Timothy Cruz after he reviewed the investigation conducted by Norwell police.

Reardon was on his way home from work on Dec. 27 when the town-owned car he was driving struck Edgard Quinones on Main Street.

Quinones, 40, was in the eastbound lane attempting to allow a car to pull into his driveway at 67 Main St. when he was struck, Ross said.

The three officers at the scene of the accident interviewed Reardon and determined that there was no indication of alcohol being involved, said Ross, who was also at the scene.

‘‘There was absolutely no indication that there was any type of alcohol (involved), and it was determined that he was on his way home from work,’’ Ross said.

Quinones was listed in fair condition at South Shore Hospital the day after the accident, and is now recovering at home, according to a friend who answered the phone at his home.

Reardon was put on administrative leave during the investigation, but his status at the department was unclear as of Friday night.

Driving to endanger is a criminal charge. A conviction is punishable by a fine of $20 to $200, imprisonment from two weeks to two years or both. The Registry of Motor Vehicles can also suspend a defendant’s driver’s license following a conviction.

The investigation was conducted by an accident reconstruction officer with the Norwell Police Department. State police had initially been called to the scene, but did not continue the investigation, said State Police Lt. Eric Anderson.

Ross said that keeping the investigation within the department was following policy and did not affect the ability to conduct a fair investigation.

‘‘It’s not within the same department, and I have the utmost confidence in my officers to conduct a thorough investigation,’’ said Ross. He said the officer who conducted the investigation had received special training in accidents involving pedestrians and bikers.
The completed investigation was handed over to the DA’s office earlier this week for review and recommendations, Ross said.

Ed Shoulkin, an attorney at Taylor, Duane, Barton and Gilman in Boston who is representing Quinones, said his client has no comment at this time.

The police department has forwarded the charges to Hingham District Court.
