PORTSMOUTH — If Michael Petersen wasn't holding an open can of beer on Pleasant Street New Year's Eve, police wouldn't have known he's a fugitive from justice, wanted on Florida charges of grand theft and burglary.
"I definitely had a beer in my hand," Petersen said Wednesday, during his arraignment in Portsmouth District Court for a violation open container offense and a felony fugitive charge.
Petersen, 21, of 129 Lafayette Road, North Hampton, was arrested Dec. 31 at 11:30 p.m., after Officer Nicole Mercer saw him walking downtown with the open beer, according to court records.
In an affidavit to the court, Mercer said she asked Petersen for identification and he said he could only provide a credit card. After checking his name and date of birth with dispatch, the officer learned he was wanted in Florida for charges of burglarizing an unoccupied building, grand theft and being a fugitive, according to the officer's report.
Petersen pleaded guilty to the open container offense and was fined $100, with $50 a day credit given for two days of his pretrial confinement. He entered a plea of not guilty to the felony fugitive charge and waived extradition to Florida.
If Florida officials do not come to New Hampshire to take him to the Sunshine state for prosecution within 30 days, Peterson will be brought back to the district court for review of his case.
