Westford patrolmen's union switches to new labor representation

WESTFORD -- The Westford police patrolmen's union has new representation.
The Westford Police Association voted to join the New England Police Benevolent Association, ending its relationship with labor attorney Timothy M. Burke.

"We know we made the right decision and are proud to be affiliated with the New England PBA," former Westford Police Association President Michael Croteau wrote in a press release. Croteau recently decided not to seek re-election.

Croteau didn't say why Westford patrolmen decided to join the union.
Burke was unavailable for comment yesterday.

The New England Benevolent Association represents 80 police unions with more than 2,500 members in Massachusetts and New Hampshire, including officers from Tyngsboro, Dracut, Chelmsford, Billerica, Wilmington, and recently, superior officers in Lowell.

"We're very excited to have (Westford) on board," said Gerald Flynn, executive director of the New England Police Benevolent Association.

The union was formed in 2005 by Flynn, a former Lowell police officer, and Lowell police Detective Bryan McMahon, the union's president, and expects to have over 3,500 members by July.

Flynn, executive director of the union, said one of their strengths is that it's run by current and former law-enforcement officers who understand the profession.

Flynn, a former vice president of the International Brotherhood of Police Officers, (IPBO) said the union wasn't providing adequate service for their members.

Flynn said the New England Police Benevolent Association offers legal services from two separate law firms, and is affiliated with the International Union of Police Associations, part of the AFL-CIO, the American Federation of Labor and Congress of Industrial Organizations, the largest federation of labor unions in the U.S.

Thomas McEnaney, Westford's deputy police chief was recently appointed police chief, and will take over the department on Jan. 1. "The department is certainly going in the right direction," Flynn said. "We'll be able to work together with management to make sure their members are properly represented."

The formation of the Police Benevolent Association two years ago can be traced to a political fallout between the International Brotherhood and some of its members who went on to form the new association, and some of the animosity still exists.
One factor to which the split is attributed is a lawsuit filed nine years ago by a former Lowell police officer who said she was sexually harassed by her colleagues on a bus trip to a political rally for former governor Paul Cellucci that was sponsored by the International Brotherhood. The International Brotherhood and representatives who were named, including the new director of the Police Benevolent Association, lost the case, and in 2005 the woman was awarded a $2.2 million judgment.

The forming of the New England Police Benevolent Association can be traced back to a group of Police officers who worked for the IBPO but found they couldn't sell a product they no longer would use themselves. The IBPO is run by people who have never been in Law Enforcement. When The Nage/IBPO President David Holloway was being arrested for OUI he told the arresting officer"I represent assholes like you". That is the way that whole management team feels about Cops. Holway has told people that the Cops are to expensive to represent. But he has no problem taking our money.

Ya we are expensive compared to janitors and office workers. By the nature of our work we take away peoples liberty put them in cuff's and send them to jail. We have the authority, under certain circumstances to take someones life. Ya we are expensive to represent they knew that when they took our money.

As for the "Bus Case" it occurred in 1998, that was ten years ago. New England PBA was founded in 2005, so what does that have to do with over 90 police locals leaving IBPO.

Dont take my word for this you can do your own research, besides Flynn won his case at Civil Service, Middlesex Superior Court and Massachusetts Appeals Court. So I guess I'd rather be with the guy who knows how to defend his members and wins.

Hey Motor 23;

You need to educate yourself before you write stuff you have NO IDEA what you are taking about. Flynn was never charged with Sexual Harassment, he was found "responsible" $1.00 in federal court for renting the bus. As a union president we have all done that - it was the IBPO and another officer (ex-boyfriend of defendant) who was found liable for the 2.2 million dollar judgment.

Owned how?. I never used Flynn's name. I posted why some departments where leaving the IBPO. After reading his name I learned more. Read the start post. This topic was just that, why people were leaving the IBPO. If that's getting owned then dam. I need a tougher room.

You really need to read the Decision of the Massachusetts Civil Service decision, where Flynn and three other officers were dismissed and reinstated with full back pay. The same anti-union civil dervice commission that brags about screwing cops. Or the 13 page scathing decision of the Middlesx Superior Court judge also exhonerating Flynn and the three others. In fact, their case against the City of Lowell is scheduled for trial this month in Federal Court.

Yeah, he was found responsible $1.00 in Federal Court in the Bus Case because he was the union president and..for renting the bus. Flynn and the other guys were never charged with sexual harassement. It was a boy-friend/girlfriend love hate relationship and they got dragged into it because it was a union trip.

“Flynn Finally Vindicated”

BOSTON — Lowell officials have agreed to pay a total of $40,000 to the former head of the police union and current Executive Director of the New England PBA, I.U.P.A., AFL-CIO, and a Lowell police officer as the last part of a settlement in the infamous Lowell police union “bus trip” case.
Former Lowell police union head Gerald Flynn and Officer Daniel Otero have argued since their lawsuit was filed in 2001 that their civil rights were violated because they were punished unfairly for alleged sexual harassment they had nothing to do with.
The accuser, then-Officer Vanessa Dixon, said she was humiliated and sexually harassed during a union-sponsored bus trip to a political rally in October 1998. Dixon said her ex-boyfriend, Officer John “Jay” Leary, started the incident. Leary was fired. Flynn, Fuller and the Oteros were suspended for 30 days. The state Civil Service Commission nullified the punishment.
Dixon later won a $2.2 million award in her federal case.
Flynn, who was part of the bus trip, alleges he was actually punished because he endorsed then-Gov. Paul Cellucci, while Davis endorsed challenger Scott Harshbarger. In the agreement, a copy of which was provided by Flynn, he will receive $30,000 of settlement with $10,000 to be paid within 30 days, another $10,000 by Jan. 29, 2009, and $10,000 by Jan. 29, 2010.
The city also agrees that Flynn will continue his leave for union duties until Feb, 21, 2014, but he can also request to work private details during his leave of absence. Otero will receive $10,000 as part of the settlement.
“This lawsuit was never about the money, but rather about vindication. Nearly 10 years later - I finally feel vindicated,” Flynn wrote in a prepared statement. “I would like to thank City Manager (Bernie) Lynch and Police Superintendent (Ken) Lavallee for having the courage of their convictions and for finally righting a wrong done to me and my family.”
Last week, U.S. District Court Judge Nancy Gertner approved an agreement between the city and officers Angel Otero Jr. and Scott Fuller, which allows both to be promoted to sergeant, where were improperly denied. The four officers alleged that then-City Manager Brian Martin and then-Police Superintendent Edward Davis “conspired” to charge him with sexual harassment even though there was no evidence.
As part of the settlement, Fuller and Angel Otero will receive all seniority and salary benefits as of Jan. 10, 1999, but no retroactive compensation. The city must also pay $70,000 of lawyer fees for Angel Otero and Fuller.
