Prosecutor: Inmate threatened to blow up sheriff's house

MIDDLETON - A tow truck driver awaiting trial on theft charges allegedly threatened to blow up the Newburyport home of Essex County Sheriff Frank Cousins - then repeated the threat when questioned by jail officials, a prosecutor said.
Jonathan Payne, 22, of Stoneham pleaded not guilty during his arraignment yesterday in Salem District Court to one count of making threats.
Payne was sent to Middleton Jail on Nov. 30 after being unable to make his $2,500 bail in a Lynn burglary case, prosecutor Jane Prince said.
Payne was "extraordinarily disruptive from the moment he arrived," the prosecutor told Salem District Court Judge Michael Uhlarik.
Payne professed that he was a "full-out Crip," referring to a notorious street gang and threatened to "bang out" another inmate who was a member of the rival Bloods gang.
"I'm a Crip through and through," Payne allegedly told guards during one of a series of incidents at the jail last week. On Dec. 2, he allegedly flooded his cell by stopping up his toilet. Later that day, a guard said he demanded to use the phone to call someone named "Shorty, or I'll see you in court." The next day, he allegedly soaked his mattress.
On Friday, Payne allegedly asked a guard the sheriff's home address, warning that he was "going to blow him up."
It was the second time that Payne had asked about where Cousins lives, Prince said. Questioned two days later by investigators, Payne repeated the threat, Prince said.
As Prince detailed the allegations in court, Payne, dressed in a blue sweatshirt, smirked and shook his head.
Defense lawyer John Morris said his client was a married father of three, with two more on the way, who worked full time as a tow truck driver to support his growing family. He said Payne was in fear of being attacked by members of the Bloods gang and that jail officials had refused to protect him.
Uhlarik revoked Payne's bail in the pending Lynn case and added another $3,000 bail on the threats charge.
If Payne is released while the case is pending, he is ordered to stay away from the sheriff.
He is due back in court on Jan. 17.
Paul Fleming, a spokesman for the sheriff, said Cousins is always aware of his security and personal safety and is not taking any additional precautions as a result of Payne's alleged threats.
