Brockton Woman Killed In School Bus Accident

An elderly Brockton woman crossing the street using her walker was hit by a school bus. WBZ

An elderly woman was killed in Brockton on Friday, right in front of her home.
The woman was using her walker to cross the street when she was struck by a school bus that was carrying some children.

It happened at about 4 P.M. Friday afternoon on Belmont Street, which is also Route 123, in Brockton.
Witnesses say an elderly woman, using a walker, was crossing the street in front of her home when she was hit by the bus. "Lady with a walker, got hit in the crosswalk, knocked her a good 25-30 feet. And they were applying C.P.R. and the whole nine yards, and it didn't look good for the pedestrian", said Witness Ed Roderick.
Police are looking into whether weather may have been a factor. It was snowing pretty heavily at the time of the crash, and at least one witness says the slippery roads played a factor. "He tried to stop slowly, and then he hit her. That's all he told me. No he didn't stop. He stopped but slided because of the snow."
The victim, whose name hasn't been released, was rushed to Good Samaritan Hospital, where she was pronounced dead.
Neither the bus driver nor, the kids on-board the school bus was hurt. However the driver was taken to the hospital for observation as a precaution.
So far no charges have been filed against the bus driver, and police are investigating.

School bus driver cited for fatal crash in Brockton

BROCKTON— Police have cited the driver of a school bus that struck and killed a 46-year-old disabled pedestrian last Friday.

The driver, Tracy A. Lopes of Raynham, was transporting several young Brockton public school students when the crash occurred on Belmont Street, according to an accident report and school authorities.

The bus struck and killed Lisa J. Herlihy, a city resident who suffered from osteoporosis and was using a walker to cross the street.

Police cited Lopes, 42, on a charge of failing to yield to a pedestrian in a crosswalk, the accident report shows.

Herlihy was crossing Belmont Street when she was struck by the bus, which had taken a right turn onto the road from Manomet Street, according to the report.

She had lived in an apartment at 287 Belmont St., just yards from where the crash occurred.

Friends said Herlihy was most likely taking her daily walk to Dunkin' Donuts at the time.

The crash is still under investigation, and no further charges have been filed against the driver, according to Lt. John Crowley, chief of detectives for the Brockton police.

The crash happened about 3:45 p.m. Friday. The full-length, yellow school bus was carrying students home from the Keith School, which serves preschool and kindergarten students, according to Brockton schools spokeswoman Jocelyn Meek.

The bus was nearing the end of its route and only three students and a bus monitor remained on board at the time of the crash, Meek said.

None of the passengers were injured, and parents picked up their children, she said.

The Brockton schools are providing counseling to the students and the bus monitor, according to Meek.
Emergency workers found Herlihy unresponsive at the scene, and she was later pronounced dead at Caritas Good Samaritan Medical Center.

Her metal walker, mangled by the crash, had to be pulled out from underneath the front of the bus by a tow truck.

Lopes, the driver, suffered unspecified injuries in the crash and was transported to Brockton Hospital, according to the accident report.

She was no longer listed as a patient at the hospital Monday, a staff member said.

Lopes has held a license to operate a school bus since 1997, according to Anne Dufresne, a spokeswoman for the Registry of Motor Vehicles.

In October 1992, Lopes was held responsible for an accident in Brockton, according to her driving record.

Contact information for Lopes could not be located Monday.

The national bus company First Student is the operator of the bus involved in the crash.

A spokesman for the Hanson branch of the company, James Quinlan, did not immediately return a call seeking comment Monday afternoon.

Funeral services for Herlihy will be held Wednesday at 10 a.m. in the Farley Funeral Home, 358 Park St., Stoughton.

Herlihy leaves her mother and five siblings. She was a graduate of Southeastern Regional Vocational Technical High School in Easton and an avid sports fan, according to her obituary.

Herlihy had been attending an adult day care program in Stoughton, according to the obituary.

Charge dropped against driver in fatal Brockton school bus crash

BROCKTON —
A motor vehicle homicide charge against a school bus driver who fatally struck a disabled pedestrian in Brockton last December has been denied in court.
Tracy A. Lopes of Raynham had been charged with motor vehicle homicide by negligent operation after her bus struck and killed 46-year-old Lisa Herlihy of Brockton. A Brockton District Court clerk magistrate denied the charge after a closed-door hearing last week and a subsequent review of the case, court staff said Friday.
More details were not available because documents from clerk magistrate reviews are not made public, staff said.
Herlihy suffered from Parkinson’s disease and osteoporosis. She had been using a walker to cross Belmont Street when she was hit as the bus took a right turn onto the road from Manomet Street, according to a police report.
The bus contained three young Brockton students and a bus monitor but none of them were injured.

I wonder if this is an insurance/lawsuit issue. If the operator was found responsible, then it would it have been a "deliberate act" on her part, rather than "negligence"?

Negligence on the part of an employee opens up the "deep pockets" of either the bus company or their insurance carrier instead of just the operator, who probably doesn't have a pot to pee in.

I bet the family of the victim asked for this to be dumped.

We had a thing like this a few years ago where someone was run over while on a picket line and that's what happened.

She stated that she was only visiting and was told it was okay......... Her name and DOB come back to seven Alpha and 6 Xray numbers out of different addresses in Milford and Framingham but she has "never been pulled over before". Must be a common name
