Endangerment charges eyed

Prosecutors are wading into the state’s murky child endangerment law to determine if it applies to a nine-months pregnant woman busted for allegedly shooting up heroin Sunday morning in the parking lot of a McDonald’s in Lawrence.
A spokesman said Essex District Attorney Jonathan W. Blodgett is investigating “as to the possibility of potential additional charges.”
Massachusetts defines a child as any person under 18 years of age, but doesn’t specify if that includes an unborn baby.
Kristie Hall, 24, of Concord, N.H., and the baby’s father, John Faria Jr., 35, of Billerica already are charged with child endangerment for using heroin in front of Hall’s 2-year-old daughter, Isabela Noury.
That was “ugly” enough for the state Department of Social Services to take custody of the toddler.
“As you can imagine, we stepped right in on this,” said DSS spokesman Richard Nagle. “It’s the kind of thing that leaves you shaking your head.”
Lawrence police Chief John J. Romero said a man parked next to the couple’s Jaguar allegedly saw Hall being injected by Faria with what the witness assumed was heroin.
“He said he probably wouldn’t have said anything, but when he looked in the back seat he saw a kid,” Romero said.
Both Hall and Faria have criminal records, according to court documents. Police seized from their car a bag of needles and other drug paraphernalia.
The unborn baby’s grandmother-to-be, Donna Faria of Billerica, said she had no idea her son and Hall were doing drugs.
“I’m in disbelief over it,” she said, adding she fears for the baby’s health.
“I’ve got to speak to a doctor. I’ve never been in a situation like this before,” she said. “I wish I could bring the baby home and take care of it.”
Meanwhile, Isabela’s father, Aaron Noury, 35, is scheduled to be releasedTuesday from New Hampshire State Prison, where he has spent the past few months for failing a drug test while on probation, said his stepmother, Kali Noury.
Noury said her stepson was not aware Hall was pregnant and will be “crushed” to learn his daughter is in state custody.
“He loves his daughter so much,” Noury said. “He babysits a lot for Kristie. She seemed like a very caring mom.”
Hall is a client of the Granite State’s Division of Family Assistance, but that agency refused to discuss her case yesterday. She and Faria are jailed on cash bails of $3,000 and $7,500 respectively.
